팬데믹의 일상화에 따른 손실보상

국문 초록

코로나-19 바이러스로 인한 팬데믹은 방역 당국의 경찰개입에 따른 손실보상의 과제를 우리에게 요청하고 있다. 정부는 코로나-19로 인한 집합금지나 제한 조치로 인해 폐업이나 영업 중단 상황을 맞은 소상공인과 중소기업 운영자들에 대한 손실보상을「감염병의 예방 및 관리에 관한 법률」과 「소상공인의 보호 및 지원에 관한 법률」을 통해 인정하고 있다. 이와 관련해 재산권 보장에 관한 전통적 논의를 새로운 상황에 적용할 것인지에 대한 후속 연구들이 진행되었다. 이글은 주로 독일의 재산권 보장과 손실보상 관련 이론을 중심으로 논의된 기존의 국내 선행연구와는 다른 관점에서 팬데믹의 일상화에 따른 현재의 손실보상은 오히려 재난법상 책임의 사회화에 따른 공적 보상이나 지원으로 이해할 수 있는지를 논의하고 있다. 그리고 손실보상의 전제가 되는 재산권 보장에 관하여는 국내에서 논의가 드물었던 프랑스 헌법과 관련 법률 및 헌법재판소 결정 내용을 검토하면서 재산권 보장에 관한 경계/분리이론이 아닌 다른 시각에서 손실보상의 의미를 해석할 가능성에 대해 고민해 보았다.

영문 초록

The transition from Pandemic to Endemic requires a new task for compensation for loss after police restriction for public order. The government recognizes loss compensation for small business owners and small and medium-sized business operators who have been closed or suspended due to collective bans or restrictions caused by COVID-19 through the Infectious Disease Prevention and Management Act and the Small Business Protection and Support Act. In this regard, major previous researches have been conducted on whether to apply traditional discussions on property rights guarantees to new situations. We study whether the current loss compensation due to the pandemic can be understood as public compensation or support for socialization of responsibility under the Disaster law from a different perspective from previous studies discussed mainly on German property rights guarantee and loss compensation. In addition, we reviewed the French Constitution, related laws, and Constitutional Court decisions, which were rare to discuss in Korea, and considered the possibility of interpreting the meaning of loss compensation(SON-SIL-BO-SANG) from a perspective other than boundary/separation theory on property rights.
