코로나 판데미 대응을 위한 독일의 학술적 정책자문 체계

국문 초록

코로나 판데미는 학술적 정책자문의 필요성을 부각시키는 계기가 되었다. 독일의 경우 코로나 판데미 이전부터 사회적으로 중요한 이슈와 관련하여 다양한 유형의 학술적 정책자문기구를 운영해온 국가이다. 독일에서의 학술적 정책자문과 관련하여, 법에서 정하지 않은 채 각 이슈별로 연방정부 차원에서 운영하는 형태의 비법정자문위원회가 빈번히 운영되어 왔다. 이와 관련하여 자율주행자동차와 관련되어 운영되었던 자율주행차 윤리위원회, 인공지능의 발전 및 데이터 경제 등과 관련되어 운영되었던 데이터윤리위원회, 데이터경제와 관련하여 발생할 수 있는 경쟁정책 자문을 위한 경쟁법 4.0 위원회 등을 그 대표적인 사례로 들 수 있다. 이러한 실무적 경향성과 궤를 같이 하여 독일의 연방정부는 코로나 판데미와 관련하여 연방 코로나 판데미 전문가 위원회라는 학술적 정책자문 위원회를 설치 및 운영하고 있다. 다른 한편 독일 연방정부는 각종 질병에 전문적으로 대응할 수 있는 보건 관련 전문지식 축적 등을 목적으로 연방 차원의 전문기관이라고 할 수 있는 로베르트 코흐 연구소를 설치 및 운영하고 있다. 로베르트 코흐 연구소는 연방행정청의 지위를 갖고 있기는 하지만, 고권적 작용을 수행하는 행정청이라기보다는 각종 질병과 관련된 정보 수집, 학술 진흥, 각종 데이터 공개 및 평가 등의 업무를 담당하는 정보행정기능을 담당하는 행정청이라고 할 수 있으며, 이러한 기능을 통해 독일 연방정부 및 각 주 정부에 대해서 질병 및 보건 관련 자문기관으로서의 기능을 수행하고 있다. 그리고 해당 분야의 전문성 제고를 위해 로베르트 코흐 연구소는 18개에 달하는 전문가 자문위원회를 별도로 구성하여 운영하고 있는데, 코로나 판데미와 관련하여 예방접종 상임위원회 및 유행성 호흡기감염 전문가자문위원회를 운영하고 있다. 본고는 이러한 독일의 학술적 정책자문과 관련된 거버넌스 구조 및 학술적 정책자문의 법적 효력을 분석하는 것을 목적으로 하며, 이러한 과정을 통해 학술적 정책자문과 관련하여 국내적 시사점을 도출하는 것을 목적으로 한다.

영문 초록

The Corona Pandemic served as an opportunity to highlight the need for academic policy advice. In the case of Germany, it can be said that it has operated various types of academic policy advisory bodies in relation to socially important issues before the Corona Pandemic; various advisory committees for social and political issues have been frequently operated without being prescribed by Act, e.g. Ethics Committee for the Self-Driving Vehicle, the Data Ethics Committee, and the Competition Act 4.0 Committee for competition policy advice, etc. In line with this administrative and practical trend, Germany's federal government has established and operated an academic policy advisory committee called the Federal Corona Pandemic Expert Committee in relation to the COVID-19. Meanwhile, the German federal government has established and operated the Robert-Koch -Research Institute, which can be called a federal-level specialized institution, for the purpose of accumulating health-related expertise that can respond professionally to various diseases. Although the RKI has the status of a federal administrative agency, it is an administrative agency in charge of information collection, academic promotion, and data disclosure and evaluation related to various diseases. In addition, to enhance expertise in the field, RKI separately organizes and operates 18 expert advisory committees, and operates a standing vaccination committee and an expert advisory committee on epidemic respiratory infections in connection with the COVID-19 pandemic. This paper aims to analyze the governance structure related to German academic policy advice and the legal effect of academic policy advice, and through this process, it aims to derive domestic implications for academic policy advice.
