공정한 수사를 위한 경찰법제에 관한 입법론의 제안

국문 초록

우리 사회는 공정한 사회를 추구한다. 공정한 사회는 부패가 없는 깨끗한 사회이고, 정의가 실현되는 사회이다. 정의가 실현되는 방법에는 여러 가지가 있을 수 있다. 그 가운데에서 사회적 부패방지를 실현하기 위하여 사회체계구조를 합리적으로 설정하는 방법도 유용하다고 할 수 있다. 그와 같은 측면에서 본 연구에서는 사회적 부패방지를 실현하기 위한 경찰수사의 공정성과 효율성의 측면에서 공정한 수사를 담보하고자 경찰법제에 관한 입법론을 제안하였다. 주지하는 바와 같이 우리 사회가 진정으로 공정한 사회를 실현하고자 한다면, 검찰과 공수처가 관장하는 일정한 범죄에 대한 수사권을 모두 경찰에게 위임하는 방안을 고려하는 것이 합당할 것이다. 이제 수사는 경찰, 기소는 검찰, 제한적 기소는 공수처로 분담하여 3자체계의 수사기관이 전문성과 책임성으로써 상호견제와 균형의 원리에 입각하는 것이 타당하다. 이에 따라 현행 「국가경찰과 자치경찰의 조직 및 운영에 관한 법률」을 바탕으로 「경찰관직무집행법」을 통합하여 검찰청법에 대응하는 경찰법으로 개정하여 입법하는 것이 타당하다. 그리고 현행 「국가경찰과 자치경찰의 조직 및 운영에 관한 법률」 제4조(경찰의 사무) ④을 신설하여 “경찰은 모든 범죄에 대하여 수사를 할 수 있다. 다만 「검찰청법 제4조(검사의 직무) ① 1호 가목·나목에 해당하는 범죄에 대하여 검사가 수사이첩을 요구하는 경우에는 검사에게 즉시 이첩하여야 한다. 그리고 「고위공직자범죄수사처 설치 및 운영에 관한 법률」 제2조 및 제23조에 의하여 수사처검사가 경찰에게 수사의뢰를 하는 범죄에 대하여 경찰은 수사를 할 수 있고, 수사결과를 수사처검사에게 송부하여야 한다.”라고 입법하는 합리적인 사고의 전환이 필요하다.

영문 초록

Our society wants to pursue a fair society. A fair society is a society free from corruption and a society in which justice is realized. There can be several ways for justice to be realized. It is also useful to prevent corruption by rationally defining the social system structure. Therefore, in this study, a legislative theory on the police law was proposed to increase the fairness and efficiency of investigations and to prevent social corruption. If our society seeks to achieve a truly just society, It would be appropriate to consider a plan to delegate all investigative rights to the police for certain crimes under the jurisdiction of the prosecution and the Corruption Investigation Office for High-ranking Officials Accordingly, it is appropriate to integrate the 「Police Officer Duties Execution Law」 based on the current 「Law Concerning Organization and Operation of National Police and Autonomous Police」 and amend it to the Police Law corresponding to the Public Prosecutor s Office Law In addition, Article 4 (Police Affairs) (iv) of the current 「Act on Organization and Operation of National Police and Autonomous Police」 shall be newly established as Police can investigate all crimes. “Article 4 of the 「Prosecutor s Office Act」 (duties of prosecutors) will also have to make a new legal text. “① When a prosecutor requests transfer of an investigation for a crime falling under subparagraph 1 (a) or (b), it shall be transferred to the prosecutor immediately.” Lastly, it is necessary to change the rational thinking that makes new legal provisions. Accordingly, Articles 2 and 23 of the Act on the Establishment and Operation of Corruption Investigation Office for High-ranking Officials should be newly added. “The police may conduct investigations on crimes for which the prosecutor of the Corruption Investigation Office for High-ranking Officials requests the police to investigate, and the result of the investigation must be sent to the prosecutor of the Corruption Investigation Office for High-ranking Office.”
