의원입법에 대한 부패영향평가 도입 가능성에 관한 소고

국문 초록

의원입법에 대한 질적 개선 노력이 필요하다는 공감대가 형성되는 가운데, 이와 관련한 다양한 연구가 나오고 있으며, 대부분의 연구는 의원입법의 질적 개선방안으로 국회의원의 전문성 강화, 입법과정에서 국민 의견 수렴 강화 등을 언급하고 있다. 본고는 다른 측면에서 입법절차에 대한 개선을 위한 방안 중 하나로 정부입법절차에서 거치는 부패영향평가제도의 도입을 제안한다. 2006년에 정부입법절차에 처음 도입된 부패영향평가는 국민권익위원회가 법안에 대해 다양한 평가기준을 가지고 분석하여 부패유발요인을 제거하도록 법제처 심사 전 단계에서 소관부처에게 권고하는 사전적 부패예방제도이다. 시행이후 2019년 12월까지 정부입법을 통한 제정 및 개정된 3,815개 법률 중 645개 법률(16.91%)이 부패영향평가를 통해 개선 권고되었다. 의원입법은 현재 부패영향평가를 받지 않고 있는 바, 의원입법에 도입 될 경우, 의원입법의 질적 개선에 도움이 될 것으로 판단한다. 하지만, 의원입법에 정부입법과 동일한 부패영향평가 절차를 도입하는 것은 행정부에 의한 국회 입법권 통제, 또는 행정부에 의한 국회의원의 입법 자율권 침해가 될 수 있기에 바람직하지 못하다. 의원입법의 질적 개선과 국회의원의 입법 자율권 보장을 모두 충족시킬 수 있는 부패영향평가 제도를 모색할 필요가 있다. 본고는 이에 대한 방안으로, 부패영향평가와 관련하여 국회법제실에서 부패영향평가를 실시하고, 국회입법조사처에서 의원입법 지원시 부패영향평가 평가기준을 고려하는 방안을 제시하였다. 효과적인 지원을 위해 국민권익위원회에게 자문을 의뢰, 국회에 부패영향분석 관련 전문관을 파견, 국회의원 보좌관 및 입법조사관 등을 대상으로 부패영향평가 교육 도입 등이 필요하다.

영문 초록

Since 2000, the number of laws introduced by the National Assembly members of South Korea has dramatically increased. With this new phenomenon, experts believe that the quality of law might be deteriorating. Previous literature suggests the National Assembly should improve the quality of laws, but they do not explain how to implement these plans. This study suggests a new tool for enhancing the quality of legislation introduced by the National Assembly members: the corruption risk assessments. The Anti-Corruption and Civil Rights Commission executes the corruption risk assessments developed to prevent corruption by analyzing corruption-causing elements in laws. The corruption risk assessments have evaluated laws introduced by the government, but they have not evaluated laws introduced by a National Assembly member due to the National Assembly members’ autonomy. This study provides plans for implementing the corruption risk assessments on the laws introduced by the National Assembly members. First, the Anti-Corruption and Civil Rights Commission should advise the National Assembly Secretariat on implementing the corruption risk assessments. Second, the Anti-Corruption and Civil Rights Commission could dispatch corruption risk assessments experts to the National Assembly Secretariat. Finally, the Anti-Corruption and Civil Rights Commission could provide training programs to the officials of the National Assembly Secretariat.
