공직부패 방지를 위한 경찰공무원 징계부가금 제도에 관한 연구

국문 초록

본 연구는 ‘징계부가금’ 제도에 대한 운영 실태를 분석하고 문제점을 도출하는 것을 목적으로 한다. 이를 위해 징계부가금에 관한 이론적 검토를 하고 소청심사위원회에 청구된 징계부가금 소청청구 사례을 실증적으로 분석하여 문제점을 도출하고, 공직부패 예방을 위한 입법·정책적 개선방안을 제시한다. 징계사유가 형사처벌 대상이 되느냐는 징계위원회에서 징계부가금 부과를 의결할 때 그리고 소청심사위원회에서 원처분인 징계부가금에 대한 결정을 함에 있에 중요한 고려 사항이다. 따라서 비위 정도에 따라 징계처분으로만 그칠 것인지 직무고발을 할 것인지 소속 기관의 장의 재량에 속하므로 재량의 한계로서 직무고발의 세부적인 가이드라인이 필요하고, 국무총리 훈령인 직무고발 지침을 기준으로 행정기관별로 보다 구체적인 사항을 규정할 필요가 있다. 제도 운영상으로는, 징계부가금 부과 대상자들에게 형평성의 문제와 제도 운영상의 모순을 해소하기 위해서 징계권자가 징계부가금 부과 의결 요구시 배수를 특정하여 요구하는 것이 아니라 징계부가금 부과 대상에 해당할 경우 부과 의결만을 요구해야 한다. 다음 단계로, 징계위원회에서 비위행위의 정도와 고의·과실 여부를 고려하여 법령에 따른 징계부가금 부과 기준의 급간을 정하고, 조정 및 감면 사유에 대해 검토한 후 최종적으로 징계부가금 부과 의결을 해야 한다. 또한, 징계부가금 제도의 도입 취지와 징계부가금 부과로 달성하려는 징벌의 효과를 고려하여 형사처벌 대상 또는 배제징계로 퇴직급여와 퇴직수당 제한에 해당하는 경우 징계부가금 대상에서 제외할 필요가 있다.

영문 초록

The purpose of this study is to analyze the operation condition of the disciplinary additional charge system and to derive its problems. To this end, a theoretical review of this system and an empirical analysis of the decisions made by Appeals Commission are conducted to derive problems and present alternatives from a legal and policy-level perspective to prevent public corruption. Whether the reason for disciplinary action is subject to criminal punishment has a significant impact on decisions when the disciplinary committee decides to impose disciplinary additional charges and when the Appeals Commission examines and makes decisions on appeals. It is at the discretion of the chief of the agency to determine whether to file disciplinary action or accusations of duty based on the degree of misconduct, so detailed guidelines for accusation of duty are needed for each administrative agencies based on the general guidelines of the Prime Minister s order. In terms of system operation, to resolve the issue of equity and inconsistencies in system operation, the disciplinary authority should not demand specific level of multiples for those who are subject to disciplinary additional charges, but just demand the disciplinary committee decides to impose disciplinary additional charges. Then, in consideration of the degree of misconduct, intention and negligence, the Disciplinary Committee determines the specific level of multiples for the disciplinary additional charges and examines the reasons for adjustment and reduction, and finally decides on the total amount. In addition, considering the purpose of the introduction of the disciplinary additional charges system and the effect of the punishment, it is necessary to exclude disciplinary additional charges if the police officials are subject to criminal punishment or disciplinary action of exclusion with the restriction of retirement benefits and severance allowances.
