국문 초록

일반적으로 피해자에게 범죄라는 정의는 중요하다. 사이버 범죄에서는 더욱 더 범죄에 대한 정의가 중요하게 작용한다. 직접적으로 생명·신체와 관련되기 보다는 재산과 명예 또는 피해를 극복하기 위한 노력과 관련되기 때문이다. 또한 사이버 범죄의 인식을 위해 전문지식이 요구되기도 하기 때문이다. 따라서 사이버 범죄 피해자는 범죄피해에 대한 재정의가 이루어진다. 이 과정에서 피해자는 피해를 회복하고자 하는 행동에 일반적으로 비용 편익적 관점에서 피해규모, 회복여부, 회복정도, 지원정도 등을 고려하게 된다. 사이버 범죄에 대하여 전문지식을 가지고 있다고 하더라도 피해회복을 위한 경제적·시간적 한계뿐 아니라 수사에 대한 권한이 한계로 형사사법기관의 신고를 통해 범죄의 진행과 확산은 물론 피해를 회복하고자 한다. 이러한 맥락에서 본연구는 크게 두 가지 질문에 대하여 해결을 시도한다. 첫째, 형사사법기관의 절차와 신뢰가 신고 의향에 영향을 미치는가?, 둘째, 형사사법기관이 사이버 범죄에 대한 처벌의 억제인식이 신고의향에 영향을 미치는지가 바로 그것이다. 사이버 범죄에 대한 탐지기술은 날로 발전됨과 동시에 이를 회피하는 기술 또한 지능적으로 진화하여 피해자가 피해인지를 어렵게 만든다. 모든 범죄는 범죄의 전체적 실태가 정확히 파악될 때 정교한 대책이 만들어진다. 이 점을 감안한다면 사이버 범죄에 대한 신고의 증가는 암수율을 감소시킬 것이다. 결과적으로 사이버 범죄의 인지에 따른 신속한 개입은 범죄를 진압하고 장기적으로 범죄를 예방하는데 기여할 것이다. 이에 본 연구는 사이버 활동이 활발한 대학생을 중심으로 설문되었으며, 사이버 범죄에 대한 인식과 신고 의향에 대해 분석을 로지스틱 회귀분석으로 시도하였다. 분석결과 사이버 범죄에 대한 처벌의 확실성이 매우 중요한 신고의 결정요인이라는 것을 확인할 수 있었다. 이는 사이버 범죄에 대한 처벌의 기대가능성이 존재할 때 형사사법기관에 신고할 의향이 존재하는 것으로 사이버 범죄 피해의 재정의를 통한 피해회복의 고려요인 중 형사사법기관의 신뢰가 중요함을 확인할 수 있었다.

important. This is because it is not directly related to life or body, but rather related to property, honor, or efforts to overcome damage. It is also because specialized knowledge is sometimes required to recognize cyber crime. Therefore, cyber crime victims are redefined for crime damage. In this process, victims generally consider the size of the damage, whether or not to recover, the degree of recovery, and the degree of support from a cost-benefit perspective to recover the damage. Even if they have specialized knowledge about cyber crime, they are not only limited in economic and time to recover damage, but also have limited powers for investigation, so they intend to recover the damage as well as the progress and spread of the crime through reports from criminal justice agencies. In this context, this study attempts to solve two major questions. First, does the procedure and trust of criminal justice agencies affect the intention to report? Second, it is whether criminal justice institutions perception of suppression of punishment for cyber crimes affects their intention to report. As cyber crime detection technology develops day by day, the technology to avoid it also intelligently evolves, making it difficult to recognize the victim. For all crimes, elaborate countermeasures are made when the overall reality of the crime is accurately identified. Given this, the increase in reports of cyber crime will reduce the male and female rates. As a result, rapid intervention based on the perception of cyber crime will contribute to suppressing crime and preventing crime in the long term. Therefore, this study was surveyed centering on university students who are active in cyber activities, and attempted to analyze the perceptions and intentions of reporting cyber crimes through logistic regression analysis. As a result of the analysis, it was confirmed that the certainty of punishment for cyber crime is a very important determinant of reporting. This indicates that there is a willingness to report to criminal justice agencies when there is a possibility of punishment for cyber crime, and it was confirmed that the trust of criminal justice agencies is important among the factors to consider for recovering damage through redefinition of cybercrime damage.
