국문 초록

현행 ｢헌법｣ 제30조는 ｢타인의 범죄행위로 인하여 생명․신체에 대한 피해를 받은 국민은 법률이 정하는 바에 의하여 국가로부터 구조를 받을 수 있다｣고 하여 국가가 범죄피해자들을 보호하고자 범죄피해자구조청구권을 규정하고 있다. 범죄로 인해 피해를 받은 국민은 국가가 구조해야 한다는 사상에 근거하여 1987. 11. ｢범죄피해자구조법｣을 제정하였고, 이후 2010년 ｢범죄피해자보호법｣을 개정하여 이에 통합하였다. 이와 같이 ｢헌법｣과 ｢범죄피해자보호법｣으로 범죄피해자의 보호와 지원을 규정하였지만, 국가가 범죄피해자들을 실질적으로 보호․지원하기 어려운 것은 국가의 예산이 절대적으로 부족한 것이 가장 큰 원인이었다. 그래서 2010. 5. ｢범죄피해자보호기금법｣을 제정하여 벌금의 일부를 이용하여 범죄피해자 보호기금으로 설치하고, 이 기금으로 범죄피해자를 보호․지원하는데 필요한 자금을 조성하였다. 그러나 현재 각 정부부처에서 개별적으로 범죄피해자에 대한 구호기금을 집행하고 있다 보니, 체계적인 사업수행이 어렵고, 신속한 범죄피해자 보호 및 지원에 대한 한계가 존재하는 등 구호기금 집행에 대한 비효율의 문제가 지속적으로 제기되고 있다. 2020년 범죄피해자보호기금은 총 1,012억이고, 이중 법무부․검찰청이 459억으로 45%, 여성가족부가 314억으로 31%, 보건복지부가 223억으로 22%를 차지한 반면, 범죄피해자를 가장 먼저 만나서 보호 및 지원해주어야 하는 경찰에 배정된 피해자보호기금은 13억으로 전체의 1.3%에 불과하는 등 보호기금의 배분에 있어 불균형이 아주 심각하다. 특히, 경찰에 배정된 열악한 보호기금으로 인하여 경찰에 의한 범죄피해자의 신속한 보호와 지원은 어렵고, 이러한 상황은 몇 년간 지속되어 왔다. 그 동안 국회 등에서는 범죄피해자기금에 대하여 특정 정부부처 중심으로 기금이 편성되거나. 직접지원비 보다는 간접지원비 과다 지원, 주거이전비, 치료비, 긴급생계비 등 기금의 지급지연 등의 문제점을 꾸준하게 제기하여 왔다. 또한 경찰에 요청하는 범죄피해자의 신변보호 건수는 급증하는 추세에 있는 반면 경찰청에 배정된 보호기금은 매년 전체 예산의 1%대에 불과하여 경찰에 요청된 피해자 신변을 보호하기에는 너무나 열악하다. 따라서 본 논문은 경찰에 배정된 열악한 범죄피해자보호기금에 입각하여 경찰의 입장에서 살펴 본 운영상 문제점과 범죄피해자 보호를 위한 재정적 확보 방안을 제시하고자 하였다.

영문 초록

Article 30 of the current Constitution states ｢A citizen who has suffered damage to life or the body due to a criminal act of another person may receive rescue from the state as prescribed by law｣; therefore, the state stipulates the right of crime victims to claim relief to protect them. Based on the idea that the state should rescue the people who are crime victims, ｢The Act of Rescuing Crime Victims｣ was enacted on November 1st, 1987, and ｢The Act of Protecting Crime Victims｣ was revised in 2010 and incorporated therein. As written above, ｢The Constitution｣ and ｢The Act of Protecting Crime Victims｣ regulated the protection and support of crime victims. However, the state faced difficulty in protecting and supporting crime victims effectively, and the biggest cause of it is the absolute shortage of its budget. Therefore, ｢The Act of the Crime Victim Protection Fund｣ was enacted on May 5th, 2010 to install part of the fines as the crime victim protection fund, and the fund raised formed money to protect and support crime victims. However, as the ministries are currently executing their own relief funds for crime victims separately, it is difficult to conduct projects systematically and also provide prompt protection and support for crime victims. In this way, problems associated with inefficiency in executing the relief funds have been raised constantly. In 2020, the crime victim protection fund totaled 101.2 billion won, of which the Ministry of Justice and Prosecutors’ Office accounted for 45% with 44.9 billion, the Ministry of Gender Equality and Family 31% with 31.4 billion, and the Ministry of Health and Welfare 22% with 22.3 billion. However, the victim protection fund allocated to the police that has to provide protection and support facing crime victims first at the front is 1.3 billion won, only 1.3% of it; therefore, disparity in the distribution of the protection fund is fairly serious. In particular, due to the protection fund insufficiently allocated to the police, it is difficult to protect and support crime victims promptly by the police, and this situation has continued for several years. Up until now, the National Assembly and related organizations have kept bringing up problems about the crime victim protection fund, for example, the fund organized particularly for some government departments, much more support for indirect support than direct support, or delay in the payment of funds such as moving expenses, medical expenses, and emergent living expenses. Accordingly, based on the crime victim protection fund poorly allotted to the police, this study has attempted to present operational problems from the perspective of the police and provide measures to secure finances for protecting crime victims properly.
