국문 초록

2020년 7월 15일, 고위공직자범죄수사처 설립 준비단이 초안을 만든 ｢고위공직자범죄등 내부고발자 보호에 관한 규정｣이 시행되었다. 동 규정은 고위공직자범죄수사처의 출범과 함께 정보제공자에 대한 보호장치를 마련한 것으로 시의적절하다고 할 수 있다. 하지만, 여러가지 미비한 점도 있다. 정보제공자를 어떻게 보호해야 하고 이를 위해서는 관련 법령을 어떻게 개정해야하는지 검토할 필요성이 있으나 아직 이와 관련한 연구를 찾아보기 어렵다. 본고에서는 ｢내부고발자 보호 규정｣의 주요 내용과 내부고발의 구성요건을 검토하고 현행법령의 정보제공자 보호에 있어서 한계를 지적하고자 한다. 현행 법령은 내부고발자와 내부고발협조자에 대해서는 보호하고 있으나, 그 외의 정보제공자는 보호받지 못하는 한계가 있다. 또한, ｢공익신고자 보호법｣과 비교해볼 때, 불이익조치 등의 금지, 보호조치, 보상금 지급, 보호조치 위반에 대한 이행강제금 부과 등이 누락되어 있어 정보제공자에 대해 충분히 보호하지 못하고 있다. 이러한 문제점들은 차후 법령 개정을 통해 개선되어야 할 사안으로 판단한다.

영문 초록

The national assembly of South Korea enacted the Act for Establishing the Anti-Corruption Investigative Agency in December 2019, and the interim organization that established the anti-corruption investigative agency also enacted the Presidential Decree for the Protection of the Whistle-Blowers Related to Grand Corruption in July 2020. Is the President Decree sufficient for protecting the whistle-blowers? How could we revise the decree to protect the whistle-blowers related to grand corruption? To answer these questions, this study examines the decree and other acts related to, and explores some cases of whistle-blowers protection. The decree has important points for protecting the whistle-blowers: the omission of written personal information, the protection of personal safety, the mitigation of culpability, and the payment of rewards. The decree is expected to play a vital role in protecting insiders. However, this decree has no articles for protecting outsiders: if the whistle-blowers are not insiders, the decree cannot protect them. This paper argues that, since there are no reasons for discriminating against outsiders, they should also be protected properly. This article concludes that, to protect outsiders, the national assembly and the Anti-Corruption Investigative Agency should revise not only the decree but also the Act for Establishing the Anti-Corruption Investigative Agency.
