자치경찰의 부패방지를 위한 개선방안

국문 초록

서울시․대전시․세종시․충청남도 등 광역시․도(이하 ‘시․도’) 중심의 자치경찰제도가 시행되었다. 자치경찰제도 시행은 민생치안에 지역별 특성에 따른 주민들의 수요에 필요한 맞춤형 치안을 추진할 수 있는 장점이 있다. 각 시․도마다 자치경찰사무를 관장할 자치경찰위원회를 구성하고 자치경찰사무에 관한 경찰인사, 예산, 임용, 평가 및 인사위원회 운영 등에 관하여 일정한 권한을 갖고 지역의 자치경찰사무 전반에 관한 책임을 지는 것이다. 따라서 국가경찰 운영과는 달리 자치경찰위원회의 구성과 운영은 주민의 생명․신체 및 재산을 보호하고 주민공동체의 안녕과 질서유지에 직결되는 중요한 일이다. 또한 다양한 주민수요와 적절한 집행이 더욱 중요시 된다. 2019년도 경찰청 발표 경찰범죄 현황을 살펴보면 총 1,672건이 발생하였다. 그 중에 직권남용이 300건, 직무유기 120건, 증수뢰 36건 등 다양한 문제점이 확인되었다. 지금까지의 경찰의 부패 예방이 법적, 제도적으로 한계가 있었을 뿐만 아니라 효율적으로 운영되지 못하고 있는 부분도 많다. 경찰부패는 경찰의 효율적인 업무수행 능력을 크게 손상시키고 치안행정에 필요한 주민의 신뢰를 손상시킨다. 자치경찰제도에서 발생할 경찰의 부패 요인에는 어떤 것이 있고 그 요인들은 경찰부패 수준에 어떠한 영향을 미치고 있는지와, 부패통제를 위해서 어떠한 것들이 적합한지를 파악하는 일은 중요하다. 경찰부패 요인은 조직내재적 요인, 업무환경적 요인, 개인적 요인 등 다양하게 나타 날 수 있다. 따라서 경찰부패의 영향요인에 대한 철저한 분석과 경찰 부패의 통제에 대한 사전연구가 필요하며 경찰업무 전반에 걸쳐 지속적인 예방노력이 절실하다고 할 수 있다. 이에 따라 경찰부패와 관련해 경찰부패의 환경적 영향요인과 여러 가지 실태를 파악한 후 자치경찰의 부패방지를 위한 개선방안을 제시하였다.

영문 초록

The self-governing police system centered on metropolitan cities and provinces (hereinafter referred to as “city and province”) such as Seoul, Daejeon, Sejong, and Chungcheongnam-do was implemented. The implementation of the self-governing police system has the advantage of promoting customized public security necessary for the needs of residents according to the characteristics of each region. It is to form a self-governing police committee to manage autonomous police affairs in each city and province, and to have certain authority over police personnel, budget, appointment, evaluation, and personnel management committee to take responsibility for the entire local police affairs. Therefore, unlike the operation of the national police, the composition and operation of the autonomous police committee is an important task that protects the lives, bodies and property of residents and is directly related to the well-being and order of the community. In addition, various residents demands and proper enforcement are more important. In 2019, a total of 1,672 police crimes were reported. Among them, various problems were identified, including 300 cases of abuse of authority, 120 cases of dereliction of duty, and 36 cases of bribery. So far, police s prevention of corruption has not only been limited legally and systematically, but also has been unable to operate efficiently. Police corruption shall greatly impair the police s ability to perform their duties efficiently and undermine the trust of residents necessary for the administration of security. It is important to understand what causes police corruption in the autonomous police system and how those factors affect the level of police corruption and what is appropriate for corruption control. Police corruption factors can be seen in various ways, including internal factors, work environmental factors, and personal factors. Therefore, thorough analysis of the impact factors of police corruption and preliminary research on the control of police corruption are needed, and continuous prevention efforts are urgently needed throughout the police work. Regarding police corruption, it is necessary to identify the environmental impact factors and various conditions of police corruption, and to seek ways to improve police corruption.
