국문 초록

WTO 회원국은 GATT 제20조에 근거하여 특정 상품에 대해 관련된 조치를 발동하여 최혜국대우, 내국민대우, 수량제한금지 등 WTO 자유무역의 기본 원칙으로부터 예외를 인정받을 수 있다. 그 중 제20조(a)는 회원국이 ‘공중도덕 보호’를 위해 필요한 조치의 시행을 통해 해당 상품의 수입을 제한 하는 것을 일반적 예외로 인정한다. 그러나 제20조(a)의 해석 및 적용은 결코 단순하고 명확하게 판단하기 어려운 조항이다. 이는 공중도덕의 범위가 각 회원국의 사회, 문화, 윤리, 종교적 배경과 가치의 차이에 따라 상이하고 조치 발동국은 그 영토 내에서 자국의 공중도덕에 대한 정의와 기준을 스스로 규정할 재량이 있기 때문이다. 이른바 ‘미-중 무역전쟁’으로 인해 중국이 미국을 상대로 WTO의 DSB에 제소한 United States – Tariff Measures on Certain Goods from China 사건은 제20조(a)의 적용 가능 여부가 핵심 이슈였고, 이에 대한 패널의 판정이 2020년 9월에 회람되었다. 패소한 미국의 항소절차가 진행 중이지만 이 사건은 제20조(a)에 대한 상세하고 명확한 법리를 제시했다는 중요한 시사점이 있다. 따라서 본 연구는 제20조(a)의 공중도덕 보호 예외조항에 대한 법리를 United States – Tariff Measures on Certain Goods from China 사건의 패널 보고서에 대한 분석을 통해 설명하고 시사점을 논한다.

영문 초록

WTO Members may take trade-restrictive measures to protect certain national interests and invoke Article XX of the GATT as a defense for the measures that would normally be regarded as a violation of the WTO obligations. Article XX(a), in particular, allows WTO Members to take measures necessary to protect public morals objective. The interpretation and application of Article XX(a) are ambiguous due to the subjective nature of public moral’s definition and scope. In United States – Tariff Measures on Certain Goods from China, the Panel clarified the elements an invoking Member of Article XX(a) must meet to prove that the measures it pursues are necessary to protect its public morals objective. Therefore, this paper seeks to analyze the legal principles of Article XX(a) through United States – Tariff Measures on Certain Goods from China and discusses its implications.
