디엔에이신원확인정보의 채취와 관리 및 이용 등에 관한 비판적 검토

국문 초록

1980년대 중반 개발된 디엔에이(DNA)분석기술은 개인식별에 있어서 매우 효과적인 수단으로 발전되면서 범죄수사나 범죄증명에 있어서 중요한 자료로서 그 활용가치가 인정되고 있다. 이에 대부분의 국가에서는 범죄자의 디엔에이신원확인정보를 채취하고 데이터베이스화하여 범죄수사에 활용하고 있으며, 범죄해결에 상당한 도움이 되는 것으로 평가되고 있다. 우리나라에서도 2010년 1월 25일 ｢디엔에이신원확인정보의 이용 및 보호에 관한 법률｣을 제정하여 시행중에 있다. 하지만 디엔에이신원확인정보는 개인정보로서 민감정보의 성질을 갖고 있다는 점에서 개인의 자기정보결정권은 물론, 채취대상자의 사생활침해의 우려가 있다. 따라서 디엔에이신원확인정보의 채취와 관리 및 이용에 있어서 헌법위반의 요소가 내재되어 있다는 점에서 절차적 정당성의 확보와 철저한 관리와 통제가 요구된다. 즉, 디엔에이신원확인정보의 채취 등의 절차에 대해서는 시행령이 아니라 법률에서 규정하고, 디엔에이데이터베이스관리위원회의 권한을 강화하여 실질적인 감독이 가능하게 하여야 한다. 또한 채취된 디엔에이신원확인정보의 관리기관을 단일화하고, 그 채취와 등록 등에 있어서 채취대상자의 의견을 적극 반영할 수 있도록 제도를 보완하여야 한다. 그리고 채취된 디엔에이신원확인정보가 누출되지 않도록 관리체계를 엄격하게 하고, 디엔에이검색의 정확성을 기하기 위하여 검색기관의 다양화하는 한편, 일반인이 디엔에이신원확인정보의 활용가능한 방법을 모색하는 것도 적극 고려해 볼 필요가 있다. 이외에 디엔에이신원확인정보의 삭제에 관련하여 삭제사유의 확대, 삭제청구권의 신설, 삭제기간의 특정 등이 요구된다.

영문 초록

DNA analysis technology developed in the mid-1980s has been developed as a very effective means of personal identification, and its value in use is recognized as an important data in criminal investigation and criminal proof. Therefore, in most countries, DNA identification information of criminals is collected and databaseed and used for criminal investigations, and it is considered to have a significant effect on solving crimes. On January 25, 2010, the Act on the Use and Protection of DNA Identification Information was enacted in Korea. However, given that DNA identification information has the nature of sensitive information as a personal information, there is a concern that the personal information of individuals may be violated as well as the privacy of those who are collected. Therefore, thorough management is required for the collection, storage, and use of DNA identification information given that it has elements that violate the Constitution in the collection, management, and utilization of such information. In other words, procedures such as the collection of DNA identification information should be stipulated by the law, not the enforcement decree, and the authority of the DNA Database Management Committee should be strengthened to enable practical supervision. In addition, the system should be supplemented to unify the management agency of the collected DNA identification information, and to actively reflect the opinions of the subject of collection in the collection and registration. In addition, the management system is strict so that the collected DNA identification information is not leaked, and the search institutions are diversified to ensure the accuracy of the DNA search, while the general public also actively considers seeking ways to utilize the DNA identification information. And, regarding the deletion of DNA identification information, it is required to expand the reason for deletion, establish a right to request deletion, and specify the deletion period.
