국문 초록

한국은 빠르게 초고령 사회로 접어들고 있다. 이는 단지 고령자 수의 증가를 의미하지 않고 사회, 문화, 경제 모든 영역에서 질적인 변화가 시작된다는 점을 의미한다. 고령자 수와 평균 수명의 증가로 우리 사회는 종래 겪어보지 않은 고령자 관련 사건의 증가를 겪으리라 예상되므로 사법제도도 이에 맞추어 대응할 필요가 있다. 고령자에 대한 복지행정도 중요한 쟁점이지만 고령범죄가 급증하는 추세이므로 고령범죄자에 대한 형사사법절차의 획기적 개선이 필요하다. 후견이나 신탁 등을 활용하여 고령자와 관련된 분쟁을 종합적으로 해결하는 방안도 모색할 필요도 있다. 고령범죄자를 포함하여 고령자에 관한 여러 법률문제를 다룰 독립적인 노인법원도입이 필요하다. 노인법원의 운영 모습은 다양할 수 있다. 고령범죄자 사건만을 전담하는 법원일 수도 있고 형사사건뿐만 아니라 관련된 민사사안도 담당하는 모습일 수도 있다. 단지 민사사안이나 형사사안만을 다루기보다 고령범죄자에 관한 사안과 합리적인 범위 내에서 일정한 민사사안까지 담당하는 것이 바람직하다. 노인법원이 고령범죄자에 대한 경미한 형사사건을 처리하고 향후 도입이 예상되는 노인보호처분의 부과 여부도 결정하도록 할 필요가 있다. 한국 사회가 고유한 전통에서 벗어나 각 세대 사이의 역할이 새롭게 전환되고 있는 시기에 있는 점에 비추어 고령자 후견이나 신탁은 매우 중요한 쟁점이 될 것이다. 학대받는 고령자에 관한 적절한 보호조치도 더욱 강화되고 보완될 필요가 있다. 노인법원 판사는 위와 같은 분야에 전문성을 갖춘 오랜 경륜의 법조인들이 지역 법관으로 임명되어 장기간 근무하도록 하는 것이 바람직하다. 노인사법 분야는 아직까지 새로운 분야이지만 인구구성의 변화에 비추어 민사, 형사법의 영역을 넘어선 종합적 연구가 필요한 분야이다. 공정하고 바람직한 노인사법시스템이 빠르게 구축되기를 기대한다.

영문 초록

Korea is rapidly entering the ranks of a super-aged society. This does not merely signify an increase in the number of elderly people, it is bringing about qualitative changes to all areas of society, culture and the economy. Because of the consistent increase in the sheer number of the elderly and life expectancy, our society is experiencing unprecedented numbers in criminal and civil cases involving the elderly, hence it has become imperative for the judicial system to change accordingly. Welfare administration for the elderly has always been an important issue in any society; however, due to the rise of criminal cases involving the elderly, criminal procedure must be dramatically revised. Further, disputes regarding the guardianship or trusts of the elderly will demand prompt and appropriate solutions. It is necessary to introduce an independent elderly court that will deal with various legal issues related to the elderly, including elderly criminals. The structure and form of elderly courts can vary. Although the elderly court could be established dedicated solely to cases involving elderly criminals; in light of the growing number of civil disputes, it may be expedient for the court to deal with civil matters within an appropriate boundary as well. The elderly courts would also be ideal in deciding on minor criminal cases against elderly offenders and as to whether protective orders for the elderly would be necessary. Further, the subject of guardianship or trusts of the elderly will become an increasingly important issue due to the sensitivity of the matter and intergenerational paradigm shifts unique to the Korean culture. Protective measures for the abused elderly must also be strengthened and better defined. It is strongly advised that the elderly court judges be appointed among long-standing legal professionals with established and potential for expertise in this area to serve as local judges for extended periods of service. The field of elderly justice though novel in our country, is one that in light of changing demographics will demand much interest and require comprehensive research beyond the fields of civil and criminal law. It is hoped that many related studies will be conducted in earnest to quickly establish a desirable elderly justice system.
