죽을 위험 중에 있는 이들의 세례에 관한 교회법적 고찰

국문 초록

교회는 온 세상에 가서 복음을 전하라는 예수 그리스도로부터 주어진 사명에 응답하며 그분께서 친히 제정하신 세례성사를 통하여 영혼들의 구원을 위해 힘써왔다. 그리고 이러한 세례성사는 그 어떤 상황에서도 결코 중단될 수 없는 중요성과 필요성을 가지고 있고, 특히 죽음의 위험 중에 있는 이들에게는 더욱더 긴급하게 요청된다고 하겠다. 그래서 교회는 특별히 죽을 위험 중에 있는 이들에게 세례가 수여될 때에 그 절차를 간소화하여 아무도 죽음으로 인해 세례의 은총과 효과를 박탈당하는 일이 없도록 배려한다. 또한 죽음이 위험 중이라는 긴급성 때문에 절차의 간소화만이 아니라, 세례의 정규집전가가 아니라도 적합한 의향만 있으면 그 누구라도 세례를 줄 수 있도록 허락하고 있으며, 세례 수여자의 의사를 직접적으로 확인할 수 없는 경우에도 그 의사를 합리적으로 추정할 수 있으면 조건부 세례도 가능성을 열어둠으로써 그 어떠한 상황에서도 세례가 가능하도록 규정을 마련하고 있다. 그러나 때로는 이런 특수한 상황에 대한 배려가 잘못 이해되거나 사사로운 이해관계에 따라서 무분별하게 임종 세례가 비정규집전자에 의하여 주어지는 일들이 사목 현장에서 발생하고 있는 것이 사실이다. 과거와 달리 현시대에는 의학의 발전과 더불어 교통과 통신의 발달로 말미암아 죽음에 대한 예견이 어느 정도 가능해졌고, 시간과 공간의 제약으로부터 더욱더 자유로워졌다. 따라서 죽음의 위험 중에 있는 이들의 세례에 있어서도 사목자의 접근이 더욱 쉬워졌고, 임박한 죽음 앞에서 비정규집전자에 의해 세례가 수여되어야 할 상황들도 자연히 줄어들게 되었다. 또한 교회는 비단 세례성사뿐만이 아니라, 그와 더불어 연속적으로 수여될 수 있는 견진성사와 성체성사를 통해 그리스도교 입문에 완전히 다가서기를 권장하므로 죽음의 위험 중에 있는 이들의 세례에 있어서 무엇보다도 우선적으로 사목자들 곧, 세례의 정규집전자들에게 임종 세례에 대한 요청이 이루어져야 할 것이다. 또한 부득이한 사정과 예견하기 힘든 상황 안에서 세례의 비정규집전자라 할지라도 한 영혼의 구원을 위해서 세례성사의 은총이 박탈되는 일이 없도록 하기 위해서 그들에게 적절하고 유용한 교육이 지속적으로 이루어져야 할 것이다.

영문 초록

The church has responded to the mission given by Jesus Christ to go to the whole world and preach the gospel, and through the baptism ordained by the Lord Himself, has been working for the salvation of souls. And the sacrament of baptism has the importance and necessity that can never be stopped under any circumstances, and it is said that it is urgently requested especially to those who are in danger of death. So the church simplifies the process, especially when baptism is awarded to those in danger of death, so that no one is deprived of the grace and effectiveness of baptism by death. Also, because of the urgency that death is in danger, it permits anyone to be baptized if the intention and simplification of the procedure is appropriate. However, it is true that sometimes, indiscriminately, the baptism of the deathbed is given to the pastoral scene. With the development of medicine and the development of transportation and communication in the present era, the prediction of death has become easier and freed from the limitations of time and space. Therefore, even in the baptism of those in danger of death, the pastor s approach became easier, and the situation in which baptism by the extraordinary minister of baptism had to be awarded before impending death was reduced. The church also encourages pastors to prioritize the baptism of those in danger of death by encouraging full access to Christian initiation, not only through the sacrament of baptism, but also through the confirmation of the sacrament and the Eucharist, which can be conferred successively. Soon, a request for baptism should be made to the ordinary minister of baptism. Also, in an unavoidable situation and unforeseen circumstances, proper and useful education should be continuously provided to them to prevent the baptismal grace from being deprived for the salvation of one soul, even if it is an extraordinary minister of baptism.
