국문 초록

우리 헌법은 시장경제질서 아래에서 사적재산의 자유로운 이용, 수익, 처분, 상속을 보장하고 있다. 그러나 재산권의 행사는 공공복리에 적합하도록 하여야 하며, 공공필요에 의한 재산권의 수용, 사용, 제한과 같은 재산권침해에 대하여 정당한 보상을 하도록 하고 있다. 재산권이 공용수용 또는 공용사용으로 인해 침해된 경우 이에 대한 근거법규가 정비되어 있는데 비하여, 계획제한과 같은 공용제한이 사회적 제약을 넘는 과도한 재산권제한인 경우에도 그에 대한 보상이 미흡한 것이 현실이다. 이와 관련하여 헌법재판소는 개발제한구역지정으로 인하여 종래의 용도대로 토지를 사용할 수 없거나 사적효용의 가능성이 완전히 배제되는 경우에도 아무런 보상없이 이를 감수하도록 하는 규정은 헌법상 비례의 원칙에 위반되는 것으로 보아 헌법불합치 결정을 내린바 있다. 이 논문에서는 우선 재산권에 대한 계획제한이 있는 경우에 그 제한의 정당성을 뒷받침하는 사회적 구속성에 관하여 살펴보고, 우리나라 헌법 제23조 재산권 구조와 독일 기본법 제14조 재산권 구조 비교해 본다. 이를 바탕으로 계획 제한에 대한 헌법재판소 결정을 경계이론과 분리이론을 중심으로 살펴보고, 향후 계획제한에 따른 손실보상의 과제에 대해 검토하기로 한다.

영문 초록

The property rights such as utilization, profits, disposal and succession of all citizens in the market-economy system shall be guaranteed in the Constitution of Korea. However, the exercise of property rights shall conform to the public welfare. And then the expropriation, use or restriction of private property from public necessity and compensation therefor shall be governed by law. Provided, That in such a case, just compensation shall be paid. Exceeding the limits of social toleration and restraint in planning restrictions due to public necessity, the compensation for an invasion of property rights is not sufficient as compared with it for the expropriation and use of them. Because there was no compensation for excess invasion of the property rights, the Constitutional Court made a judgment that the related Act for specifying areas of restricted development was not in accord with constitutional systems. This paper studies the social toleration and restraint giving a justification in the invasion of property rights, compares the property systems guaranteed in the Constitution of Korea with it in Germany, and examines judgments which the Constitutional Court made for planning restrictions. Lastly, it points out problems on the compensation for planning restriction on the property rights
