국문 초록

이 논문은 공용수용의 재결에 대한 불복제도를 연구하는 것을 그 내용으로 하고 있다. 재결은 공익사업을 위하여 타인의 재산권을 강제적으로 취득하는 수용의 마지막 절차이다. 따라서 재결에 대하여 불복하는 자는 행정쟁송절차에 따라 침해된 국민의 권리 또는 이익을 구제하고, 행정의 합법성과 합목적성을 보장하기 위하여 재결에 대한 불복제도가 필요하다. 우리나라의 토지보상법은 재결에 대한 불복제도로서 이의신청과 행정소송을 규정하고 있다. 여기에서 이의신청이라 함은 토지수용위원회의 위법 또는 부당한 재결처분으로 인하여 권리 또는 이익을 침해당한 자가 중앙토지수용위원회에 그 재결의 전부 또는 일부의 취소를 청구하거나 손실보상액의 중액 또는 감액을 청구하는 쟁송절차이다. 그리고 행정소송은 토지수용위원회의 재결에 대하여 불복이 있는 경우에 사업시행자나 토지소유자 또는 관계인이 법원에 그 재결의 취소 또는 변경을 구하거나 보상액의 증액 또는 감액을 청구하는 정식쟁송절차이다.

영문 초록

This thesis is to research on the appeal system of expropriation decision. Expropriation decision is the final stage to expropriate other s properties compulsorily for the public use. Accordingly, those who insubordinate to the expropriation decision should be relieved of the people s right and interest infringed according to the procedure of the administrative appeal, and it is necessary to have the insubordinate system to guarantee the legitimacy and fitness of the administration. The Land Compensation Law in Korea is the appeal system of expropriation decision and regulates the formal objection and administrative litigation. The formal objection here is the litigate procedure to request for a part or the whole of expropriation decision or request for the increase or decrease of the loss compensation amount to the Central Committee to expropriate land by those who have been infringed their rights or interests by the unlawful or unjustifiable expropriation decision disposition of the Central Committee to expropriate land. And, the administrative litigation is the formal appeal procedure to request for the cancellation or alteration or to request for the crease or decrease of the compensation amount by the business executors in case there is insubordination to the expropriation decision of the Central Committee to expropriate land.
