국문 초록

보험설계사는 보험 판매채널로서 매우 중요한 역할을 하고 있고, 특수직종사자 가운데 가장 많은 수를 차지하고 있다는 점에서, 보험설계사의 사회보험 확대방안은 보험법의영역에서뜨거운이슈로등장하고있다. 본논문에서저자는다음과같은세가지영역을 다룬다. 첫째, 보험회사등에소속되어있다는특징에따라보험설계사가근로자로인정해야 할필요성이있는지여부를논의한다. 대법원판례의추이를살펴보는동시에주요국에서어떻게 운영되고 있는가도 고찰한다. 둘째, 보험설계사의 고용보험의 의무적 적용을 확대하는 것이 합당한가의 문제 및 셋째, 보험설계사가 산재보험을 의무적으로 가입하는 것이 타당한가에 대한 문제를 실증적인 방식으로 논의한다. 보험설계사에 대한 고용보험과 산재보험의 의무화 방안은 보험설계사의 본질적인 특성을 고려하지 않고, 특수직종사자라고 하는 하나의 틀에 놓고서 획일적인 제도를 도입하고 자한다는점에서심각한문제라고지적하지않을수없다. 고용보험을도입하고자위해서는 보험설계사에 대한 도입 필요성의 충분한 사전 조사와 영향 등을 검토해야 하고, 당사자가 선택할수있는권리를부여해야한다. 이는산재보험의경우도마찬가지이다. 보험설계사의 이익을 위한 정책이 오히려 예상치 못한 불이익의 결과를 초래할 수 있음을 유념해야 할 것이다.

영문 초록

Insurance planners play a very important role as an insurance sales channel, and the discussion of compulsory social insurance of insurance planners is emerging as the hot issue in the area of insurance law. In this paper, the writer deal with the following three areas. First, the writer discusses whether there is a need for the insurance planner to be recognized as an employee based on the fact that it belongs to an insurance company. The writer examines the trends of Supreme Court precedents and examines the operation of insurance planner in major countries. Second, the writer examines that it is reasonable to expand the mandatory application of insurance policy for insurance planners. Third, The question of whether it is reasonable for an insurance planner to make compulsory insurance coverage is discussed in an empirical way. It is important to point out that the mandatory insurance policy for employers insurance companies and workers compensation insurance is a serious issue in that it does not take into account the essential characteristics of insurance planners and seeks to introduce a uniform system based on a single framework. In order to introduce employment insurance, it is necessary to examine sufficient preliminary investigation and influence on the necessity of introducing insurance agent, to give the right of choice to the parties. This is also the case for industrial accident insurance. It should be noted that policies for the benefit of insurance planners may result in rather unexpected disadvantages.
