국문 초록

전문성이 부족한 부동산 개발업자의 난립으로 인한 사기분양이나 허위ㆍ과장광고 등으로부터 소비자의 피해방지 및 부동산개발업의 체계적 관리ㆍ육성을 위해 부동산개발업의 관리 및 육성에 관한 법률을 제정ㆍ공포하여 시행하고 있다. 최근 동법 시행 이후 나타난 문제점을 개선하고자, 법률 및 시행령, 시행규칙의 일부를 개정하여 공포ㆍ시행하였다. 그러나 부 동산개발 전문 인력의 범위, 자본금의 설정, 업무영역 등 일부 요건에 있어 불합리한 설정과 부동산 개발업자의 육성에 관한 구체적인 방안을 제시하지 못했다. 이에 금융산업과 연관된 법률의 추가제정과 개발업자의 신뢰도와 공신력 확보 방안 등이 새로이 강구되어야 하겠다. 건전한 개발시장 정착을 위해서는 부동산개발업법의 실효성 확보와 개발업자 육성안 등 다양한 노력이 필요하겠으나 무엇보다 중요한 것은 개발업자 스스로 전문성과 능력을 갖춤으로써 정부나 소비자가 신뢰할 수 있는 브랜드로 평가 받을 수 있는 부동산개발시장을 조성해 나가야 할 것이다.

영문 초록

For the sound real estate development market to take root, it is necessary to make efforts to secure the effectiveness of the real estate development industry law and support developers. But it is said that what matters among other things is that the developer makes efforts to become the one armed with speciality and ability. This should enable consumers to evaluate the real estate development market by the developer s brand, not by the brand of the construction company, by supporting companies which government or consumers can trust. The real estate developer should handles every process ranging from development planning to feasibility study, sale and follow-up management with the initiative of real estate development. Developers should be equipped with speciality and ability to an extent that they can proceed to take the initiative in tuning, managing and supervising financing and construction. To support this, developers are required to have speciality and the ability to secure capital. Therefore, it is necessary to systematize procedures for real estate development to fit our real situation and lay the foundation for the advancement of the real estate market by improving the problems found in the real estate development law and strengthen the strengths. And it is necessary to reorganize and support developers and examine the scheme to provide support for the growth of bonafide real estate developers by giving them the incentive.
