도로공사시 도로법면부지 편입 최소화 방안 연구

국문 초록

2016년도 우리나라 국가 예산의 약 1.76%가 도로 개설 및 확장공사에 소요되고 있으나 실제 도로를 조성하는 데 필요한 사업비가 아닌 도로 조성을 위한 토지를 매입하는 데에 많은 사업비가 투자되고 있다. 특히, 고양시는 수도권에 있어 다른 자치단체에 비해 상대적으로 높은 지가로 인해 전체 사업비의 49%가 토지매입을 위한 사업비에 투자되고있다. 이처럼 막대한 사업비가 투입되는 토지매입비중 도로의 본 구간이 아닌 법면부지 매입을 위한 토지매입비가 전체 토지매입비의 23%를 차지하고있어 이러한 법면부지 매입을 위한 토지매입비를 줄일 수 있는 방안을 찾아보고자 하였다. 연구 결과 도로공사시 토지소유자와의 사전협의를 통해 법면부지에 대한 편입을 최소화하는 방안과 사업시행자와 토지소유자 간의 역할분담 방안을 제시하였다. 이를 통해 첫째, 편입토지를 최소화하여 사업비의 많은 부분을 차지하고 있는 토지매입비를 줄임으로써 사업 비용을 절감할 수 있다. 둘째, 도로부지 중 상대적으로 관리가 어려운 법면부지에 대한 편입면적을 줄이고 경계를 명확히 함으로써 도로관리의 효율성을 높일 수 있다. 셋째, 도로공사에 편입되는 것을 반대하는 토지주의 입장을 최대한 고려하여 편입토지를 최소화함으로써 개인의 사유재산권을 보호할 수 있다. 이러한 연구를 토대로 하여 고양시에서 시행 중인 도로공사를 분석하여 적용하고 이를 바탕으로 보다 체계적이고 지속적인 연구가 요구된다.

영문 초록

In 2016, approximately 1.76% of Republic of Korea national budget is spent on road construction and expansion. However, large portion of money is being invested in purchasing land for the construction rather than the actual expenses required to construct roads. In Goyang-si, particularly, 49% of the total project costs are being invested in the project fund for the purchase of land due to high land price in the Seoul metropolitan area compared to other municipalities. Since the land purchase cost for the purchase of legal land, which is not the actual section of the road, accounts for 23% of the total land purchase cost among the land purchasing expenses to which the enormous business expenses are charged, we tried to find a way to reduce the cost to purchase legal land.As a result, we proposed a plan to minimize the incorporation of the legal site through pre-consultation with landowner when constructing the road, and suggested distributing roles for project owner and landowner. First, the plan can reduce business costs by minimizing land acquisition and reducing land purchasing cost, which are large parts of project cost. Second, it is possible to increase the efficiency of road management by reducing the inclusion of land and clarifying the boundaries of the road site, which is difficult to manage. Third, it is possible to protect the private property rights of individuals by minimizing the land incorporated, taking into account the position of the landowners against the incorporation into road construction. It is necessary to analyze and apply road construction in Goyang-si and to conduct more systematic and continuous research based on this research.
