한·일 양국의 특정용도제한지구에 관한 비교 연구

국문 초록

국민의 환경 개선과 쾌적한 생활환경 유지를 위한 욕구 증가로 지역주민들의 생활환경에 악영향을 미치는 일부 용도 건축물은 건축허가 과정에서 많은 민원이 발생하고 있다. 이에 따라 허가권자는 관계법규에 근거하지 않은 집단민원 발생, 지역의 환경보호 필요성 등 막연하고 추상적인 사유를 들어 건축 불허가 처분하는 사례가 늘고 있다. 건축불허가 처분에 따라 건축주는 행정심판 또는 행정소송을 제기하여 쟁송으로 이어지고 건축주와 지역주민간의 갈등, 건축주와 허가권자, 지역주민과 허가권자의 갈등과 불신으로 이어져 이를 해결하는 과정에서 시간적·경제적·정신적 피해가 뒤따르고 있다. 본 연구는 이에 대한 해결 방안으로서 한국과 일본의 특정용도제한지구의 제도 비교를 통해 지역실정에 맞는 특정용도제한지구 활성화 방안을 제안하고자 행정심판 사건 중에서 환경보호, 주거·교육환경 보호 등을 사유로 건축불허가 처분한 현황, 한국의 특정용도제한지구 운영실태와 일본의 운영실태를 분석하여 지방자치단체 조례로의 위임확대 필요와 지구 지정시 적극적인 지역주민의 참여의 필요성을 제시하였다. 특정용도제한지구의 활성화는 지역주민의 생활 환경보호와 건축허용 여부를 제도화하여 관련법규에 의하지 않은 추상적 사유에 의한 건축불허가 처분과 관계자간 분쟁을 감소시키는데 도움이 될 것으로 기대된다.

영문 초록

With an increased desire for the improvement of environments and maintaining comfortable living conditions among residents, there have been many civil complaints reported in the process of building permits for special purpose construction that can negatively influence residential environments. Therefore, there are more cases where those who approve disapprove building permits due to abstract reasons such as environmental protection and appeals which are not supported by regulations. Disapproval of the building permits often leads to lawsuits and administrative appeals from the owners of the buildings; as a result, mistrust and conflict are built up among the owners, residents, and those who are in favor of development. In the process of dealing with this problem, everyone involved often go through psychological distress and waste their time and money. This study provides vitalizing measures for the Special purpose restricted districts adequate for the regions after comparing the cases of Korea and Japan. It analyzes the appeals regards to disapproval of building permits due to protection of living and educational environments in Korea and Japan and current management of the systems in the Special purpose restricted districts in both countries. This study suggests the need of extended delegation to ordinances and active participation of residents especially when restriction zones are assigned. Activation of Special purpose restricted districts is expected to be helpful in reducing the number of the disapproval cases which are not based on related regulations by organizing and systemizing the issue of building permits and protection of residential environments.
