세대 간 정의･인권 실현의 관점에서의 아동･청소년 선거권보장

국문 초록

본 논문은 우리나라가 직면하고 있는 세대 간 불평등의 구조로 인한 문제를 지속가능한 발전에서 제시하고 있는 요인과 함께 분석 한 후 미래세 대인 아동･청소년의 인권보장과 세대 간의 형평성을 확보하기 위한 방안제 시를 목적으로 작성되었다. 논의는 인구구성의 불균형적 구조로부터 발생하는 노인세대와 아동･청 소년의 대표의 불균형으로 인해 발생되는 세대 간 불평등의 문제로부터 출발하였다. 세대 간 불평등의 문제는 환경･복지･법･사회･정치 제도의 상당 부분이 노인세대의 이익을 반영하도록 구조화되어 있는 현실에 기인한다. 특히 재정과 자원의 상당부분이 현세대를 위해 소비되는 반면에 이를 충당 해야 할 재원은 미래세대가 상당부분을 감당해야한다는 모순은 세대 간 불평등을 심화시킨다. 이에 대한 해결을 위해서는 아동･청소년들이 그들의 관점에서 그들의 이익을 결정할 수 있도록 대표성 강화방안이 제시될 필요가 있다. 그 논거로 ‘세대 간 정의’, ‘지속가능한 발전’그리고 인권의 확장을 제시하였으며 그 구체적 방안으로는 아동･청소년의 선거권 보장을 제시 하였다. 특히 우리나라와 같은 문제를 경험하고, 해결을 위한 방안으로 선거권연령인하와 ‘Demeny voting’을 도입하고자 했던 외국의 사례를 통해서 그 해결의 지향점을 제시하였다.

영문 초록

This article is to provide a method in order to achieve the intergenerational equality and to secure human rights of children and adolescents as a future generation, after analyzing the problems caused by the inequality of intergeneration with the elements presented by the sustainable developments for Korea to face with. The discussion began with the inequality problem of intergeneration caused by an imbalanced representativeness between the old generation and the children and adolescents resulting from the unbalanced structure of population composition. The problems of intergenerational inequality stem from realities that much of the environment, welfare, law, social and political systems are structured to reflect the interests of the old generation. Especially, the intergenerational inequalities are intensified by the contradiction that the future generation has to bear a significant portion of the revenue to cover, while much of the revenue and resources are consumed by the present generation. In order to resolve this inequalities, the measure of strengthening the representativeness of children and adolescents need to be proposed to enable them to determine their interests from their perspective.It provides ‘intergenerational justice’, ‘sustainable developments’ and ‘expansion of human rights’ as legal grounds for the measure. It argues for the assurance of voting rights of children and adolescents as a specific means. In particular, it presents the direction of a solution through foreign cases that have introduced ‘Demeny voting’ and lowering the voting age.
