치료감호에 의한 자유박탈의 부당한 장기화

국문 초록

정신질환자의 범죄에 관하여 여태까지의 대응책은 치료감호대상자를 확대하는 방향으로만 이루어졌으며, 치료감호 (가)종료 기준에 대한 논의는 거의 없었다. 이로 인하여 치료감호소는 과밀화되었다. 논의가 거의 없다보니 이에 대한 개선도 거의 없어 인권침해의 문제가 여전히 존재하게 되었다. 현행 치료감호는 다음과 같은 문제가 있다. 피치료감호인이 자신이 받은 죄의 최고 법정 형보다 오래 치료감호를 받아야 하거나, 타인과 비교해볼 때 더 가벼운 죄를 지은 자가 더오래 치료감호를 받게 되는 문제가 발생할 수 있다. 이러한 문제의 원인은 개별적으로 치료감호의 기간을 두지 않으며, 치유상태보다는 과거의 범죄내용이나 경제적 능력, 인수보 호자 유무 등을 우선하는 치료감호 (가)종료 심사기준, 형의 집행에 가까운 치료감호의 집행 내용에 원인이 있다. 그러므로 이 문제를 해결하기 위해서 지난 치료감호소가 축적한 자료 등으로 개별 감호 기간을 설정하거나, 독일 형법에 존재하는 비례의 원칙을 도입하고, 치료감호의 (가)종료 심사기준을 대폭 개선하는 방향으로 제도 개선이 필요해 보인다.

영문 초록

Until now, expending subjects for medical treatment and custody was the only way of meeting criminal acts of feeble-minded person. No one considered examination standards for the end or suspension of medical treatment and custody. Because of this, Gongju Institute of Forensic Psychiatry has been overcrowded. And humanights violations problems have not been solved. Recent Medical treatment and custody of Korea has problems. First, the period of inmates in facilities of medical treatment and custody can be longer than statutory punishment of their crimes. Also the period for a minor offender can be longer than the period for a major offender. The causes of the problems are these; the individual period of inmates in facilities is not set, the other examination standards are criminal fact, individual economic strength or a existence of protector is prior to healing state of inmates in the facilities, and state facilities are no different from prison. In order to solving the problems, individual period of inmates must be set in the facilities experience and in documented experience for about 30 years. The Principle of proportion of Germany should be introduced in Korea. Also the examination standards for the end or suspension should be reformed.
