국문 초록

이 연구는 성범죄 예방 및 억제를 목적으로 성범죄자에 대한 효율적인 관리와 인권보장을 위해 신상정보등록 및 공개제도 관련 선진국인 미국의 사례를 통해 한국 신상정보등록 및 공개제도를 위한 시사점을 제시하는 것이다. 이에 본 연구는 연구결과로서 세 가지 시사점을 제시하고자 한다. 첫째, 객관성이 보장된 재범위험성 평가 및 평가기준의 마련이다. 미국과 같이 신상등록 대상자를 선정하는 기준을 성범죄 경중, 재범위험성에 기초하여 등록대상자를 구분하여야 한다. 그리고 재범위험성 분석 및 그결과판단을 위한 객관적인 기준을 마련해야 한다. 둘째, 유죄판결내용에 근거한 신상정보등록기간의 차등화를 실시하는 것이다. 20년이라는 일률적인 기간에서 벗어나 선고받은 형별의 경중에 근거하여 차이를 두어야 한다. 셋째, 재범방지를 위해 신상정보를 공개할 때 대상자와 관련된 다양한 정보를 제공하여야 한다. 미국과 같이 범죄자 개인에 대한 구별이 가능한 구체적인 정보 (신체특징 등)를 추가로 제공하여야 한다.

영문 초록

This study is to provide implications for Korean sex offender notification system based on the American system to suggest effective management of and guarantee human rights for sex offenders. For this purpose, this paper provides three implications. First, we must setup objective recidivism evaluation procedures and criteria. In the United States, sex offenders are classified and registered in the notification system based on seriousness of offenses and risk assessment evaluation decisions. Also, risk assessment evaluations and decisions must have objective decision criteria. Second, sex offender personal information notification periods should be differentiated based on the reasons for guilty verdicts and the seriousness of sentencing. Third, when personal information is notified. various information about a sex offender should be included in the system. Personal and specific information, such as physical characteristics should be provided in order to well-distinguish offenders. Implications for this study were further discussed.
