배심원의 성별과 피해아동의 연령이 성범죄 가해자 처벌판단에 미치는 영향 - 진술신빙성의 매개효과를 중심으로-

국문 초록

본 연구에서는 20~30대를 대상으로 배심원의 성별과 피해아동의 연령이 가해자 처벌판단에 미치는 영향과 피해아동의 진술 신빙성의 매개효과를 검증하고자 하였다. 참여자들은 아동 성학대 인식을 측정하는 문항에 응답한 후, 피해아동의 연령(만 4세 vs. 만 12세)이 조작된 재판 시나리오를 읽고, 피해아동의 진술신빙성, 가해자에 대한 유·무죄판단, 유죄확률, 양형판단에 대해 응답하였다. 연구결과, 여성배심원이 남성배심원에 비해 더 높은 유죄확률을 나타내었으나 유·무죄판단과 양형판단에서는 차이가 나타나지 않았다. 또한 모의 배심원들은 피해아동의 연령이 더 어릴수록 가해자에 대한 많은 유죄판단과 높은 유죄확률을 나타내었으나 양형판단에서는 유의하지 않았다. 상호작용 분석결과, 유죄확률과 양형판단에서는 배심원 성별과 피해아동 연령의 상호작용 효과가 나타나지 않았으나, 유·무죄판단에서는 상호작용 효과가 나타나 ‘여성배심원×만 4세 아동’ 조건에서 유죄판단이 가장 많았고, ‘남성배심원×만 12세 아동’조건에서 유죄판단이 가장 적었다. 다음으로 피해아동의 진술신빙성은 배심원의 성별과 유·무죄판단, 유죄확률의 관계를 각각 매개하였으나 배심원의 성별과 양형판단, 피해아동의 연령과 가해자 처벌판단의 관계를 매개하지 않았다.

영문 초록

The purpose of this research is to investigate the effect of juror’s gender and the child victim’s age on the verdict and the punishment of defendant and whether the child victim’s statement credibility mediates these decisions. The participants answered questions measuring child sexual abuse knowledge, and read trial scenarios on sexual assaults on a child. The child victim s age was manipulated(age 4 vs. age 12), and answered questions related to child victim’s statement credibility,verdict against the defendant, guilty percent and sentence. The results suggested that female jurors gave higher guilty percents than male jurors. However, there was no difference on verdict and sentence. Moreover, mock jurors gave more guilty verdicts and higher the guilty percent but there was no difference in sentencing decisions when the child victim was younger. According to the interaction analysis, there was no significant difference in guilty percent and sentence. However the conviction was the highest in the ‘female jury×four-year-old’ condition and lowest in the ‘male jury×twelve-year-old’ condition. Next, there was mediated effects in the statement credibility on the relationship between the juror’s gender and the verdict and guilty percent. However, there was no mediated effects in the statement credibility on the relationship between the juror’s gender and sentence, the child victim’s age and the legal decisions.
