경찰의 데이트 폭력 대응 방안문제점의 및 개선방안에 관한 연구

국문 초록

경찰청 자료에 따르면, 데이트 폭력으로 형사 입건된 인원은 2011년 7,292명에서 2017년 10,303명으로 약 1.4배 증가한 것으로 나타났다. 또한 데이트 폭력은 매 년 70%이상이 폭행과 상해의 형태로 발생하였고, 살인으로 지난 7년간 총 689명이 입건된 것으로 볼 때 데이트 폭력이 더 이상 연인간의 문제가 아닌 심각한 범죄행위인 것을 알 수 있다. 이러한 데이트 폭력의 심각함을 인식한 경찰과 여성가족부 등 관계부처 합동으로 「스토킹ㆍ데이트 폭력 피해방지 종합대책」을 발표한 바 있다. 경찰은 데이트 폭력에 대한 경찰 대응력과 피해자 신변보호 조치를 강화하기 위해 각 경찰서 형사과장을 팀장으로 한 데이트 폭력 근절 TF(Task Force)를 설치 및 운영하고 있으며, 집중신고기간 운영, 112신고 시스템 상 ‘스토킹 코드’를 별도로 부여ㆍ관리하고 있다. 또한 데이트 폭력 관련 위험성이 크거나 피해자가 요청하는 경우 피해자와의 핫라인(hot-line)을 구축하는 등 피해자 보호방안 등을 강화하여 대응하고 있다. 하지만 데이트 폭력에 대응하는 경찰관들은 데이트 폭력의 심각성에 관하여 인식이 부족하며, 데이트 폭력과 스토킹 범죄와 밀접한 관련성을 가지고 있음에도 불구하고 데이트 폭력은 형사과에서, 스토킹 범죄는 여성청소년 과에서 업무를 분장하여 담당함으로 일선에서는 업무에 대한 혼선을 야기하고 있다. 뿐만 아니라 데이트 폭력의 경우에는 일반 법적으로 그 처벌 규정은 따로 마련되어 있지 않으며, 데이트 폭력은 높은 재범률을 보이고 있음에도 불구하고 ‘6개월 이상’이라는 비교적 단기간의 보호조치기간을 제시하고 있다는 점에서 범죄 특성을 제대로 반영하지 않고 있는 것으로 보인다. 따라서 이연구는 경찰의 데이트 폭력 대책들을 중심으로 문제점을 분석하고, 이에 대한 개선방안을 제안하고자 한다. 데이트 폭력 대책의 개선방안으로는 첫째, 일선경찰관들을 대상으로 전반적인 데이트 폭력에 대해 가지고 있던 선입견을 해소시킬 수 있는 전문 교육 프로그램을 도입해야 하며, 둘째, 데이트 폭력 및 스토킹 범죄를 한 기능에서 담당할 수 있는 업무분장의 일원화가 필요하며, 셋째, 관련 규정의 제 정비를 통해 경찰권 발동의 근거를 명확하게 제시하여 적극적인 범죄예방과 피해자 보호가 이루어 질 수있게 하여야 한다. 넷째, 데이트 폭력에 대한 심층있는 범죄분석을 통하여 적합한 예방대책의 개발 및 맞춤형 피해자 보호대책을 수립할 필요가 있다.

영문 초록

According to the National Police Agency, the number of people who were arrested for dating violence increased 1.4 times from 7,292 in 2011 to 10,303 in 2017. In addition, more than 70% of dating violence occurred in the form of assault and injury each year, and a total of 689 people have been arrested for murder in the last seven years. Thus, it is clear that dating violence is no longer just a matter between lovers but a serious criminal act. The police and the Ministry of Gender Equality and Family, which recognized the seriousness of dating violence, have jointly announced 「Comprehensive Measures to Prevent Stalking and Dating Violence」. In order to strengthen coping ability against dating violence and protection of victims, police have set up and operated Dating Violence Eradication TF(Task Force), implemented the intensive reporting period, managed the Stalking Code on the 112 reporting system, and created a hot-line with the victim if the victim is requested to do so or they are considered to be at risk. However, a majority of police officers responding to dating violence are not aware of the seriousness of dating violence. Moreover, although dating violence is closely related to stalking crime, dating violence is being addressed in Criminal Affairs Division, and stalking crime is being addressed in Women and Youths Division, which is causing confusion in the front lines. Also, in the case of dating violence, there is no provision for punishment under the general law. Most importantly, despite the high recidivism of dating violence perpetrators, it appears that it does not adequately reflect the nature of the crime in that they are disposed of only for a relatively short period of protection measures of six months or more .Therefore, this study focuses on police violence measures, analyzes the problems, and suggests ways to improve them. First, it is necessary to introduce a professional education program to eliminate the overall prejudices about the dating violence that police officers have had. Second, it is necessary to unify the role of a task that can address dating violence and stalking. Third, the revision of the related regulation should provide a clear basis for the police officers right to act, so as to prevent dating violence and protect victims. Lastly, we should develop appropriate preventive measures and customized victim protection measures through in-depth crime analysis on dating violence.
