국문 초록

일반인들의 범죄와 형벌에 대한 인식은 양형기준 및 형사정책의 방향을 설정하는 근거가 된다는 점에서 매우 중요하다. 여성 대상 범죄보도는 선정성과 피해자 비난하기 등의 문제점이 지적되어 왔으나 이를 접한 일반인들의 인식에 어떠한 영향을 미치 는가는 잘 알려져 있지 않았다. 이에 이 연구는 여성살해 사건에 대한 신문보도가 대중의 범죄와 형벌에 관한 인식에 미치는 영향을 시나리오 실험법을 통해 검증하고자 하였다. 연구의 목적을 위해 피해자 비난 및 가해자 옹호관련 내용을 각색한 범죄시나 리오를 구성하고 이에 대해 대학생들을 대상으로 설문조사를 실시하였다. 실험결과, 피해자 비난 시나리오에서는 ‘피해자 비난 고’ 집단의 참가자들이 상대적으로 가해자에 대한 형량을 낮게 부과하고, 범죄행위에 대한 도덕적 비난 가능성에 대해 낮게 인식 하는 것을 확인할 수 있었으며 이러한 집단 간 차이는 모두 유의미한 것으로 나타났다. 또한, 형량, 범죄피해 심각성, 도덕적 비난가능성에 대해 ‘가해자 옹호 저 집단’이 ‘고 집단’보다 높은 평균을 보였으며 이러한 집단 간 차이는 유의미한 것으로 확인되었 다. 이와 같은 결과는 결국 여성피해자에 대한 엄격한 결백성의 요구, 가해자 옹호와 같은 간접적이고 은밀한 전략의 사용증가, 여성대상 범죄에 대한 사회적 차원의 대책 미비와 같은 문제점이 나타날 수 있음을 시사한다.

영문 초록

The perception of crime and punishment by the public is very important in that it sets the basis for sentencing and criminal policy. In previous research, the crime reports of women have been pointed out the problems such as sexuality and victim blame. However, it is not well known how this affects public perception. Therefore, this study aims to analyze the influence of femicide reports on the public perception of crime and punishment through the scenario experiment method. For the purpose of the study, the crime scenarios consisted of ‘victim blame high / low and perpetrator defense high / low .Finally, 520 college students responses were used in the analysis. As a result of the experiment, in victim blame scenarios, ‘victim blame high group’ showed a lower average than ‘victim blame low group’ about the sentencing and possibility of moral criticism. And the difference between these groups was significant. On the other hand, perpetrator advocacy low group showed a higher average than perpetrator advocacy high group about the sentencing, seriousness of crime, possibility of moral criticism. Also, these group differences were found to be significant. These results suggest that there may be problems such as the need for strict innocence against female victims, increased use of indirect and confidential strategies such as advocacy of offenders, and lack of social measures against female crimes
