국문 초록

이 논문은 탄핵제도의 세부 내용인 탄핵절차 개시 후 대통령 사임 문제에 관하여 새로운 접근법을 통해 진행한 연구이다. 일단 이 논문은 당해 문제에 관한 각국의 사례, 국내와 미국에서의 논의를 검토하는 한편, 이 문제의 시간적 범위를 주로 탄핵소추의결의 효과와 관련시켜 일반적으로 ‘탄핵소추의결 후’로 한정하고 있는 국내적 논의들을 비판하면서, 그 시간적 범위를 ‘탄핵절차 개시 후’로 확장시켜 탄핵절차 진행 과정 전반에 관련된 문제로 접근해야 한다고 주장한다. 또한 이 논문은 탄핵이 ‘사임한 대통령의 책임에 상응하는 징벌’이 되어야 한다는 관점에서 당해 문제를 보다 구체적인 세 가지 문제로 구분하여 분석한다. 그 가운데 첫 번째, 탄핵절차 개시 후 대통령이 사임할 수 있는지 여부에 관해서는 헌법상 비례의 원칙에 따라 판단할 문제이다. 두 번째, ‘탄핵절차 개시 시점’과 ‘탄핵소추의 대상’ 사이의 연관성 문제, 즉 탄핵절차 개시를 이유로 사임한 대통령을 예외적으로 탄핵소추의 대상에 포함시킬 수 있는가에 관해서는 ‘탄핵절차의 개시 시점’을 언제로 판단할 것인지에 의존하는 문제이다. 세 번째, 사임한 대통령에 대한 탄핵이 ‘심판청구의 이익’이 있는지, 다시 말해 사임한 대통령에 대해 예외적으로 탄핵절차 개시를 이유로 그 진행 정도에 따라 절차를 계속해야 하는가에 관해서는 ‘탄핵소추의 사유’에 대한 확인으로써 해결할 문제이다. 특히 세 번째 문제와 관련해, 이 논문은 방법론적인 새로운 틀로서 경제학에서의 무차별 곡선을 응용한 ‘대통령 사임-탄핵’ 모델도 추가로 제시한다. ‘대통령 사임-탄핵’ 모델은 세부적으로 매우 복잡하고 난해한 내용들을 포괄하고 있는 당해 문제를 종합하여 ‘하나의 단순화된 그림’으로 표현하는 장점이 있다는 점에서, 이 문제에 관한 이해의 편의, 문제 해결의 효율성 객관성 합리성, 그리고 발생 가능한 다양한 상황들에의 보편적 적용 가능성까지 널리 확보할 수 있다.

영문 초록

This article provides a new methodological approach to analyse the Presidential resignation after initiation of impeachment process. Existing theories often argue that, since temporal scope of this issue has special relevances with the effect of Assembly’s or Congress’ approving the motion to impeach, this issue occurs only when that authority has made the decision. However, the scope should be broadened, because of relation between this issue and the whole impeachment process, whether before or after that has approved it. Furthermore, impeachment should be the corresponding penalty for responsibility of resigned President. So that, in this article, to explain in the more details this issue is divided into three specific themes. First, the question of whether the President could resignation after initiation of impeachment process should be solved by the principle of proportionality in the constitution. Second, the question, as the relevance between ‘the time of initiation of impeachment process’ and ‘subject of the impeachment’, of whether the President who has already resigned for the initiation of impeachment could be exceptionally the subject of impeachment should be solved by the time when the impeachment process begins. Third, the question of whether the impeachment against him could have an ‘interest of request for trial’, that is, whether the impeachment process after his resignation must be exceptionally continued on account of the initiation of impeachment, should be solved by analysis of ‘grounds for impeachment’. Especially in relation to the third theme, this article suggests the ‘Presidential Resignation-Impeachment’ model as a new methodological tool, which is an application of indifference curve in economics. In the way that the ‘Presidential Resignation-Impeachment’ model has the merit of being able to express this issue including complex and intricate matters in details as ‘a single of simple figure’, we can obtain the benefits of being easy to understand this issue, of the efficiency, objectivity, and rationality of problem solving, and of the universal applicability in a variety of possible situations by making use of this model.
