국문 초록

문화재보호는 개발중심의 한국사회에서는 매우 활발하게 연구되는 분야는 아니다. 개인의 재산권의 신장, 지속적인 개발논리, 시의성 등 여러 가지 이유로 인해 문화재 보호에 관한 연구는 뒷전으로 밀려나는 것이 현실이고, 특히 등록문화재는 지정문화재보다 보호가치가 낮은 문화재라는 인식 때문에 활발한 연구가 진행되진 않았다. 그러나 저출산 초고령화 현상으로 인해 문화재 향유 수요 증가가 예상되고 수도권에 집중된 인구가 지방으로 분산 되면서 지역을 중심으로 한 문화재의 보존 및 활용의 필요성이 대두되고 있다. 특히 지역문화 재생자원으로 활용될 수 있는 근 현대문화유산 보호의 중요성이 부각되었다. 한국은 특히 문화재보호법 을 중심으로 한정된 재원과 인력을 활용하여 문화재를 효율 적으로 보존하기 위해서 문화재중 특히 중요한 문화재를 지정이나 등록을 통해 중점적으로 보호하는 중점보호주의를 취하고 있다. 그 중에서도 문화재중 극히 가치가 높은 것을 선정 하여 국가의 강한 규제와 지원을 통하여 영구적으로 보존하고자 하는 지정제도 위주로 운영되어 왔다. 그러나 1990년대 산업화 현상이 가속화되면서 지정되지 않은 문화재, 특히 근 대문화유산에 대한 보호의 목소리가 높아져갔다. 이에 대한 반응으로 2001년 7월에 근대문화유산을 보호하기 위하여 문화재 등록제도가 도입되었다. 문화재 등록제도가 도입되었음에도 불구하고 등록문화재 제도의 저조한 활용, 중앙중심의 등록문화재 제도 운영, 등록예고대상에 대한 법적 보호 부재 등으로 인해 등록문화재 제 도는 도입취지와는 달리 근 현대문화유산을 보호하기 위한 수단으로서 효율적으로 운영되지 못하고 있는 실정이다. 효과적인 근 현대문화유산의 보호를 위해서 등록문화재 제도의 정비가 요구되고 있는 바, 본 논문에서는 등록문화재 제도를 통해 보호되는 근 현대문화유산의 개념을 명확히 정의하고 등록문화재 제도를 검토하여 그 한계점을 분석한다. 이를 통해 근 현대문화유산의 보호 관리 강화를 위한 등록문화재 제도의 개선방안을 강구하는 것이 본 논문의 궁극적 목표이다.

영문 초록

The cultural heritage protection is an unpopular study in Korea. By reason of the increase in individual property rights, persistent development, untimeliness and so on, studies in the preservation of cultural heritage have practically laid aside. Especially, the studies upon registered cultural heritage have not been lively performed, because an ordinary person think that the value of the heritage is less than the value of state-designated cultural heritage. However, the low fertility and the population ageing are likely to result in an increasing demand for cultural enjoyment and population decentralization from the capital to the other provinces, and the need to protect and utilize cultural heritage comes to the fore. Particularly, emphasized is the protection of modern and contemporary cultural heritage, which can be the cultural and reproductive resources for a region. The cultural heritage protection policy of Korea, following the Cultural Heritage Protection Act, with limited budget and short manpower, takes up the priority protectionism which preserves in priority certain cultural heritage of particular importance by means of the designation or the registration for the effective protection. Between the protective measures, or the designation and the registration, the principal one has been the former which seeks the permanent preservation of cultural assets which are recognized most valuable by strong regulation and support. However, the accelerated industrialization in the 1990s resulted in growing voices for the protection of the non-designated cultural heritage, especially of the modern ones. These voices, in June 2001, finally won the registration system to protect modern cultural heritage. A poor use and the centralized operation of the registration system and the absence of the legal protection of cultural assets registered for public announcement, despite the adoption of the system, hinder an effective operation of the system as a protective measure for modern and contemporary cultural heritage. To meet an increasing request to tune up the registration system and enhance effectiveness and efficiency, the article defines the notion of modern and contemporary cultural heritage which the registration system protects, first, and then the system itself is analyzed. With the result, the article points out drawbacks of the current legal system. Focusing on the legal defects, the improvement of the current registration system is devised to cope more effectively with the modern and contemporary cultural heritage.
