학생의 일실이익의 산정에 관한 비교법적 고찰

국문 초록

현대는 다양한 사고에 노출되어 있다. 사고로 인하여 인명피해가 발생할 경우 손해배상의 산정은 현재의 소득을 기준으로 정해지는 바, 이러한 산정방식은 특히 학생의 경우장래의 수익기회 상실이라는 소극적 이익이 제대로 반영되지 않는 문제점이 있었다. 일실이익에 대한 축적된 판례를 분석하여볼 때, 법원은 사고 당시 대학생인 피해자의 일실이익을 산정하는 경우 대학에서의 전공이 졸업과 동시에 자동적으로 장래의 직업과확실히 연관이 될 수 있다고 경험칙으로 인정되는 경우만을 인정하는 취지로 보아 이를 제한적으로 인정하고 있었다. 이와 달리 영국 및 미국, 독일, 프랑스와 같은 외국법원은 대체로 기회상실이론을 적용하여 수익기회를 상실한 피해자의 입증책임을 완화하는 한편, 가해행위자에게도 그 가해행위로 인한 손해의 범위를 보다 정확하게 산출하여 손해의 공평하고 타당한 분담의 요청에 기여하고 있다. 또한 일본법원에 있어서도 후유장애과 같이 상대적으로 추정이 모호한 부분에 있어 전문가의 감정을 적극 활용하여 이를 통해 얻어진 결과를 토대로 수익기회의 실현가능성을 합리적으로 판단하고 그것을 토대로 법관의 자의적 결정을 상당부분 줄여 손해산정에 관하여 예측가능성을 높이는 방법을 택하고 있다. 종래 법원과 같이 수익기회의 상실에 대하여 재산적 손해의 배상을 인정하는 것에 대하여 상당히 엄격한 태도를 견지한다면 특히 학생인 피해자가 충분한 배상을 받지 못하는 결과가 초래될 수 있는바 이러한 불합리를 해소하기 위하여는 수익기회의 상실로 인한 재산적 손해배상액의 산정에 있어 해당 전문가를 감정인으로 적절하게 활용하여야 하고, 재산적 손해배상의 인정에 있어 유연한 태도를 견지하여야 한다. 또한 수익기회의 상실로 인하여 예외적으로 위자료가 인정되는 사안에서도 종래 위자료의 액수가 상당히 낮은 금액이어서 피해자의 손해전보에 충분치 못하다는 비판을 고려하여 수익기회의 실현기능성, 가해행위의 태양 등에 비추어 위자료가 실질적으로 상향 조정되어야 하는 방향으로 나아가야 할 것이다
