제주특별자치도 자치경찰제도의 특성 검토

국문 초록

정부수립 후 계속적으로 자치경찰에 대한 도입논의가 있었으나 결실을 맺지 못하고 있다. 2006년 제주특별자치도 설치 및 국제자유도시 조성을 위한 특별법 이 제정되어 제주지역이라는 한정된 공간에 한해서 자치경찰을 실시하고 있다. 그동안 치안행정인 자치경찰에 대한 국민의 염원이 달성된 경우라 할 수 있다. 또한 2004년 지방분권특별법 제정에 의해 우리나라에서도 자치경찰을 실시할 수 있는 자치경찰의 범적 토대를 마련하여 그 결실을 맺게 되었으며, 현재 자치경찰법(안)이 국회에서 논의 중에 있다. 입헌민주주의헌법을 가지는 국가 대다수가 지역실정에 부합하는 자치경찰을 실시하여 오고 있다. 자치경찰은 이론상 지역주민의 치안수요에 부응할 수 있고, 민주성확보와 정치적 중립성확보를 달성할 수 있는 장점을 가지나 자칫 잘못하면 오히려 지역 정치가로부터 자유로울 수 없어 정치적 중립과 민주성을 국가경찰제도보다 저해할 가능성을 가지고 있다. 따라서 정치적 중립성확보와 민주성확보를 위하여 자치경찰제도 내에 견제와 균형의 원리에 입각한 관리ㆍ감독기관의 설치가 중요하다. 우리 제주특별자치도의 자치경찰도 지역치안서비스를 제공하고 지역주민에 봉사하는 경찰제도로 나아가기 위하여는 경찰기관에 대한 민주적 통제수단을 가지고 있어야 한다. 이러한 민주적 통제장치를 가지고 있는 경우는 이론적으로나 실질적으로 완전한 자치경찰을 달성할 수 있다. 본 연구는 제주특별자치도 설치 및 국제자유도시 조성을 위한 특별법 을 중심으로 제주특별자치도에 실시하고 있는 자치경찰제도의 특성 중 자치경찰기관과 자치경찰기관을 감독할 수 있는 치안행정위원회의 특성을 검토하였다. 본 연구는 제주특별자치도 내의 자치경찰기관 중 그 소속과 구성 그리고 치안행정위원회의 소속과 구성 및 권한 등에 한정하여 살펴보았다. 그리고 본 제도가 가지고 있는 문제점을 파악한 후 이에 대한 향후 발전방안을 제시하였다. 이러한 이론적 고찰은 자치경찰의 새로운 방안을 마련할 수 있는 토대를 제공하는데 기여할 것으로 기대한다.

영문 초록

The roles of the police, who protect the lives and properties of the people, are limited to keep public peace inactively coming from Germany. Korean police system is thought to have started since GAB-0 reform in 1894. Particularly, at the time when the national right was taken away by Japanese invasion, the police controlled the people by wielding oppressive authority. The police system in the period of bang ruled by the army of the United States had tried to operate self-governing police under center-governing police control by accepting parts of American police system. Building up a government in 1948 made it fix again complete center-governing police system There have been continuing issues to introduce local-governing police since the establishment of the government, but there had not gotten aey good results. Finely, Je-Ju island was chosen to perform autonomous police in 2006 when Special Law was set up to make Je-Ju international liberal city. Additionally, Local Authority- Decentralizing Special Law in 2004 built up the basement of self-governing police system Many of the countries in the world, which are constitutional democracies, carry into effect autonomous police suitable for the regions. It has both of positive and negative effects. Good thing in theory is to make sure public peace in local areas, the other thing is to attain democracy and political neutral. In Contrast, it can hamper the two factors above, because they can t be free from local politicians. Thus, it is important to come up with some institutions to hold them in check Je-Ju police should have democratic measures to curb police agency in order to provide safe public peace and service its localities. The democratic control means are able to carry self-governing police to perfect one theoretically and practically. This paper have reviewed some characteristics of Je-Ju police by focusing on the Special Law which Wis established to build Je-Ju Special Self-Governing Province and international city. Based on those above, this paper suggested developmental ideas in future. This theoretical consideration is going to help offer the fundamental of new and creative ideas to make sure local-goveming police
