국문 초록

공무원의 헌법상 지위와 관련하여 우리 헌법은 제7조 제1항에 “공무원은 국민전체에 대한 봉사자이며, 국민에 대하여 책임을 진다”라고 규정되어 있으며, 제2항에서는 공무원의 신분과 정치적 중립성이 직업공무원제도의 중요요소로 보고 있다. 공무원은 국가과제 및 공공업무를 수행하므로 공공성을 추구하여 공익을 실현하고, 특히 직업공무원은 정치적 공무원과의 관계에서 기능적 권력통제의 기능을 수행하며, 공무원은 헌법적 가치와 법령을 구체화하는 법치주의 실현의 주체가 된다. 이러한 공무원제도를 유지하기 위해서는 신분보장, 정치적 중립성, 능력주의가 필요하며, 이러한 제도로부터 공무원은 헌법상 헌법준수의무, 국가이익 우선의무, 정치적 중립성의무, 국민의 자유와 복리의 증진의무, 청렴의 의무, 지위남용금지의무를 부담한다. 헌법재판소는 여러 판결을 통해 공무원의 신분보장과 정치적 중립성을 보호하는 결정들을 남겼으며, 특히 사회국가원리의 공직제도에의 적용을 통해 공무원의 후생복지제도의 중요성을 강조하였다. 방어적 민주주의에 입각하여 공무원에게도 헌법에의 충성의무, 특히 자유민주적 기본질서의 수호의지가 요구된다. 우리 공직제도는 연금제도의 강화와 맞춤형 복지제도 개선을 통해 그들의 책임과 기능에 어울리는 적합한 보수체계를 가져야 한다. 공무원의 보수체계는 제도의 목적들을 얻어내는 방법으로 인식되어져야 하고, 공무원의 부패를 막고, 공적의무들을 수행하는데 부적합한 행동을 하지 않도록 충분하여야 할 것이다.

영문 초록

About the constitutional status of public official says the Art.7 (1) of Korean Constitution that “public official is servant for all korean people, and takes responsibility for all korean people” and Art. 7(2) regards the guarantee of social status and political neutrality as core elements of public official system. The public official must seek public nature and public interest, keep functional control of politician. They becomes main agents of legalism, who materialize constitutional values and legislation. The guarantee of social status, political neutrality and performance-related promotion are necessary to keep Public official system. Inherent obligations are imposed on public officials in the exercise of their public functions. They include respect for the Constitution, taking interests of state first, political neutrality, obligation of improving freedom and public welfare, strict integrity and prohibition of position abuse. The Constitutional Court of Korea has protected the guarantee of social status and political neutrality of public official, and stressed the importance of welfare system by applying social state principle. According to defensive democracy must public official have loyalty to the Constitution, especially to free democratic basic order. Our public official system should have an adequate remuneration commensurate with their responsibilities and function by improvement of pension and tailor-made welfare system. Remuneration should be regarded as a means of achieving desired organizational goals and should be sufficient so as to ensure that public officials are not put at risk of corruption or engaging in activities incompatible with the performance of public duties.
