국문 초록

본 논문은 스웨덴의 행정제도의 특징을 염두에 두면서 스웨덴의 의회옴부즈만과 행정감시의 관계를 설명한다. 또한 제도도입의 역사적 변천과정의 고찰을 통해 유관행정감시기관 간의 업무중첩문제를 둘러싼 현실적 타개법을 검토한다. 이를 위해 독립성의 확보, 조사권의 확보와 의무, 권고권과 의회에 대한 설명책임성의 관점에서 설명한다. 스웨덴의 의회옴부즈만의 특징으로는 독립된 기관으로 강력한 조사권과 문서에 대한 자료열람권을 가지며, 공적기관의 의무불이행에 대해 권고권과 권고에 불복하는 경우 특별검찰관으로서 소추권을 발동한다. 한편 복수로 설치되어있는 독립행정기관 간의 중복업무로 인한 행정기관 간의 첫돌방지를 위해 각 행정감시기관들은 긴밀한 상호연락을 취해 비교우위의 관점에서 민원을 처리하여 비효율성을 차단한다. 결론적으로 의회옴부즈만의 원활한 행정감시기능을 위해서는 독립성, 조사권, 권고권, 소추권 등의 확보가 주요한 요소임을 강조한다.

영문 초록

This article explores the relationship between the Swedish parliamentary ombudsman and the supervision of administration by considering the characteristics of the administrative system in Sweden. By exploring historical process in the introduction of the ombudsman system in Sweden, this article examines substantial and realistic measures to avoid business duplication among the related public institutions. For this, some aspects such as independence from administrative and political authorities, the power to investigate and its duty created by the authority, right of advice to the civil petitioner and accountability to the parliament are explained. In addition, some unique aspects of the Swedish parliamentary ombudsman such as independence from political influences, compulsory access rights to documents, the power to investigate the civil petitioner and right of accusation are emphasised.
