리조트 경영계약에서 분양방식과 수수료 체계의 특성 분석

국문 초록

본 연구는 국내 리조트가 국제적인 경영회사와 리조트 경영계약의 체결에 있어서 표준경영계약 내용을 고찰하기 위한 것으로 리조트 경영계약에서 국내 리조트의 구조적 특성을 반영하는 분양방식과 위탁경영 수수료 체계의 특성을 분석한 것이다. 본 연구는 17명의 리조트 개발 및 경영 전문가를 대상으로 반구조화된 개방형 인터뷰 설문을 실시하였으며, 2단계에 걸친 분석과정을 통하여 연구 결과를 도출하였다. 분석 결과, 리조트 분양방식의 특성인 소유권과 사용권, 수분양자 모임의 동의서, 입회금 반환 방식 및 분양률에 대해서는 경영회사와의 합의를 통해 리조트 표준경영계약 조항에 반영시켜야 한다는 것을 확인할 수 있었다. 또한 위탁경영 수수료 체계와 관련하여 총매출 및 영업이익 달성과 수수료의 지급을 연동시킬 필요가 있다는 것을 확인할 수 있었지만, 마케팅 수수료를 포함한 특정 서비스의 경우에는 수수료의 개념이 아닌 비용의 개념으로 접근해야 한다는 것을 파악할 수 있었다. 본 연구는 국내 리조트가 국제적인 경영회사와 리조트 경영계약을 체결할 때 국제적인 호텔 표준경영계약을 넘어 국내 리조트가 가지고 있는 구조적 특성을 반영한 표준조항이 반영된 별도의 경영계약이 필요하며, 소유주와 경영회사 간에 효율적인 의사교류를 통하여 경영계약이 체결되어야 한다는 것을 논의하였다는 의의가 있다.

영문 초록

This study explored contents of standard management contract between local resorts and international management contract company to reflects structural characteristics of local resorts, in more specifically, it looks at the lotting-out and management fees system in the resort management contract. This study was conducted semi-structured open-ended interviews with seventeen experts, the results of analysis were obtained in two steps. finding from the interviews indicate that characteristics of resort lotting-out and management fees system are both reflect to the standard contract form. in addition, characteristics of resort lotting-out include of ownership and membership, consent form of ownership, returns enrollment fee, and lotting-out rate, also management fee system need to be linked to the payment fees and achieved gross operating revenue (GOR), gross operating profit (GOP). On the other hand, specific services include of marketing fees are approached cost rather than management fees. The major contribution of this study it that it confirms need to differentiated management contract form into reflects structural characteristics of local resorts when local resorts were signed management contract with international management company, it confirms need to effective exchange opinions between resort owner and management company. This study deals with the current situation, problems and improvement of local resorts management contract despite a lack of data. hence, it provide useful data when the local resorts owner contract with an international management company.
