국문 초록

학교폭력에 대한 개념적 접근은 먼저 사회학적 측면에서 시도되었고, 이어 법적 접근으로서 규범적 측면에서 개념정립이 이루어지고 있다. 학교폭력에 대한 개념을 명확히 정의하는 것은 어렵다. 학교폭력을 바라보는 시각에 따라서 사회학적 개념과 법학적 개념이 다르기 때문이다. 또한 학교폭력의 유형이 계속해서 변화하고 있고, 학교폭력의 개념인 학교 폭력이 현재 진행형이기 때문이다. 학교폭력예방법에 규정된 학교폭력의 개념은 그 기준이 애매하며, 그 보호범위가 추상적이며 넓다. 이러한 넓 은 범위를 설정함으로써 학교폭력의 문제를 포괄적으로 해결하기 위한것으로 보이지만, 현실은 강한 보호가 아닌 약한 보호가 되고 있다. 오 늘날 학교폭력의 문제는 그 심각성에 있어서 약한 보호로서는 해결하기 힘들며, 강력한 법적 준거를 마련하여 강한 보호로서 해결하여야 한다. 특히 최근의 학교폭력의 사이버유형의 증가와 새로운 형태의 보복이 등장하여 더욱 강력한 보호를 위한 제도적 장치가 필요하다. 따라서 범위를 넓히기 보다는 범위를 좁혀 학교안에 한정하여 보다 강력한 보호를 할 필요성이 있다. 그러기 위해서는 학교폭력예방법이 ‘학생을 대상으로’ 하기 보다는 ‘학교 내에서 학생들간의’ 문제에만 국한해서 적용해야 할 것이다. 학교폭력의 개념 중 유형에 대한 부분도 형법용어를 그대로 사용하기 보다는 학생들이 이해할 수 있는 구체적인 용어로 바꾸어 학교폭력의 행위가 무엇인지를 명확히 하여야 할 것이다. 본 연구는 학교폭력의 개념을 규범적 측면에서 구체화 하고 명확히 하여 학교폭력의 법적 대응을 보다 강화하기 위한 것을 목적으로 한다. 학교폭력의 현상에 대한 접근과 분석에 있어서는 사회학적 접근 유용성이 있지만, 법적 강제력에 의한 대응을 위해서는 규범적 개념정립이 필요하다. 본 연구는 학 교폭력에 대한 개념정의에 있어서는 사회학적 및 규범적 측면이라는 두 개의 측면에서 접근하고 학교폭력 문제의 규범적 해결이라는 점에서 학교폭력예방법에서 개념정의에 따라 논의를 전개한다.

영문 초록

Sociology first tried to have a conceptual approach to school violence and now its concept is being established from the normative perspective as a legal approach. It’s not easy to clearly define school violence partly because concepts that sociology has differ from those defined by science of law and partly because types of school violence keep changing and school violence, which is the concept of school violence is still on-going. Its concept stipulated in the school violence prevention act is vague, its standards are vague and its protection scope is abstract and broad. Setting such a broad scope seems to be good in comprehensively solving school violence but in reality, it provides a weak, not strong protection. Weak protection can hardly solve the seriousness of school violence these days. We need strong protection by preparing strong legal base. Especially, as cyber types of school violence and new types of retaliation appear in relation to school violence, systematic gadgets providing much stronger protection are in need. Accordingly, not broadening its scope, but limiting it to ‘within school’ will provide stronger protection, for which the school violence protection act should not ‘target student’ but be limited to issues only ‘among students.’ Regarding types among concepts of school violence, penal terminologies should be abstained from being used as they are but changed to ones easy for students to understand so that what are behaviors falling under school violence can be clarified. This study aimed to concretize and clarify the concept of school violence from the normative perspective with its goal of strengthening legal measures to be taken against school violence. Regarding approach to and analysis of school violence phenomena, ones by social studies are useful but it’s also necessary to normatively establish its concept if measures by legal force is intended. The current study approached the conceptual definition of school violence from the sociological and normative perspectives while it unfolded its discussion along the concept defined in the school violence prevention act from the perspective of normatively solving the issue of school violence.
