독일교원의 정치활동 자유 및 제한에 관한 고찰

국문 초록

독일기본법상 교원의 정치적 활동에 관한 자유는 일반적인 의사표현의 자유(기본법 제5조 1항), 집회의 자유(기본법 제8조), 결사의 자유(제 9조 1항) 등에서 그 근거를 찾을 수 있다. 이 같은 교원의 정치활동의 자유는 교원 대부분이 국공립학교에 소속되어 있기 때문에 국가공무원이란 신분적 특수성으로 인해 자유민주주의적 기본질서의 범위 내에서 충실의무에 반하지 않는 한 폭넓게 허용되고 있다. 따라서 교원은 수업 중 지식전달의 목적으로 자유롭게 정치적 견해를 표현할 수 있을 뿐만 아니라, 정당에 자유롭게 가입할 수 있으며, 교육공무원으로서 근로관계에 기해 자유롭게 교원노동조합 및 교원단체를 결성할 단결권을 갖는다. 교원단체가 다양한 정부정책에 관여할 수 있는데 이는 학교감독권이 교회 로부터 국가로 이관되기까지의 오랜 정치투쟁의 결과적 산물이기 때문이다. 반면 우리나라는 국가공무원법 제65조(정치운동의 금지), 교육기본법 제6조 및 제14조 제4항, 사립학교법 제55조 등에서 일부대학교원을 제 외하고는 초‧중‧고등학교 교원의 정치활동은 포괄적으로 금지하고 있다. 교원의 정치활동에 대한 자유를 보장하라는 주장이 오랫동안 지속되고 있는 국내교육법적 현실을 볼 때 독일식의 포괄적 허용은 아니더라고 단계적 허용을 통해 교원의 법적 지위를 보다 공고히 하는 방향으로 나아가야 할 것이다.

영문 초록

The freedom of teacher’s political activity stated in the German fundamental law can be found its origin from the freedom of expressing general opinions (clause 1, article 5 of fundamental law), the freedom of assembly (article 8 of fundamental law), and the freedom of association (clause 1, article 9). Because most teachers are belonged to national public schools and have their special status of a national civil servant, the freedom of teacher’s political activity is widely allowed unless he/she does not act against the duties to be faithful in the scope of liberal, democratic basic order. Therefore, a German teacher can express his/her political opinion freely for the purpose of transferring some knowledge during a class, and can also join a political party freely, as well as has the right to organize the teachers union and a teacher group freely. Besides, a German teacher group can involve in government’s various educational policies, because the right is the outcome of teachers’ long political struggle until the right to supervise schools could be transferred from the church to the nation. Contrary to Germany, Korea comprehensively prohibits any political activity of teachers working in elementary, middle and high school except a few university/college professors according to the article of Government Officials Act (prohibiton of political campaign), the article 6 and the clause 4, article 14 of Fundamentals of Education Act, and the article 55 of Private School Act. Given domestic education law’s real situation that the insistence arguing that the freedom of teacher’s political activity should be guaranteed has been existed for a long time, the Korean education will have to go further in the direction strengthening a teacher’s legal status by allowing the freedom of teacher’s political activity gradually gradual (in-phase), even though not allowing the freedom comprehensively like the German case.
