재·보궐선거제도의 합리화를 위한 제언

국문 초록

재·보궐선거의 실시회수는 선거체계(대표원칙, 선거주기 등), 선거문화, 후보자·당선인·공직자의 준법의식, 공천을 주도하는 정당정치의 수준 등에 의하여 결정된다. 따라서 재·보궐선거제도를 합리적으로 구성·운용 하기 위해서는 전체적인 관점에서 접근하여야 할 것이다. 법경제학적으로 볼 때, 재·보궐선거는 부득이한 경우에 최소의 비용으로 실시하는 것이 바람직하다. 이를 위해서는 재·보궐선거의 발생가능성을 최소화하거나 다른 충원방식을 모색함으로써 재·보궐선거의 실시필요성을 최소화하는 것이 필요하다. 우리의 선거체계와 선거규범 및 정치현실을 고려할진대, 상대적으로 용이하게 시도할 수 있는 방안으로 재·보궐선거의 실시회수를 제한하는 것을 주장한다. 재·보궐선거를 연 1회 실시하되, 그 실시시점을 7월로 정하는 것이다. 법리적으로는 논란의 여지가 있으나 정치현실의 변혁을 추동한다는 의미에서 고려할 만한 입법론으로, 다른 선거출마를 위한 입후보 시기의 제한, 범죄로 말미암아 재·보궐선거를 실시하게 만든 자에게 선거비용을 부담시키거나 선거보전금액을 환수하는 것, 범죄의 사유로 재·보궐선거 를 실시하게 만든 공직자의 소속정당에 대한 제재(공천권의 제한, 국고 보조금의 감액 또는 환수) 등을 들 수 있다. 이러한 제한 또는 제재는 무책임하게 재·보궐선거를 유발하였던 정치세력에 대한 실질적인 견제수단이 될 것이다. 장기적인 방안으로는 행정규제 중심의 선거법제의 완화, 정치자금제도의 적실성 있는 보완, 선거주기의 일치, 대체후보제의 도입, 다양한 선거 체계의 도입 등을 들 수 있다.

영문 초록

The number of reelection and by-election(hereafter, “by-election”) is determined by the following factors: electoral system (representative principle, electoral cycle etc.); election culture; law-abiding consciousness of the candidate, elected and public officials; the level of political parties that nominate the candidates for the elections. A holistic approach is, therefore, necessary from overall points of view in order to configure and operate the re-election scheme reasonably. It is desirable to hold a by-election at a minimal cost if unavoidable. For that purpose, it is desirable to minimize the necessity of by-election and explore other ways to fill the vacancies than holding a by-election. Our electoral systems and norms taken into account, it is claimed that the limitation of the numbers of by-election is an more easier measure to try: holding a by-election once a year, in July. And other ways, though arguable in legal theories but effective for the betterment of the political reality, may be worthy of consideration as follows: limiting the candidacy for the other elections, charging those for the election cost whose crimes were the causes of by-elections, imposing some sanctions against the political parties whose members’ crimes were the causes of by-elections. These restrictions or sanctions will be substantial the checkrein to the irresponsible by-elections. As the long-term strategies can be suggested deregulation of election law, relevant complement of political funding systems, coincidence of electoral cycles, the introduction of alternative candidate system and various electoral systems.
