국문 초록

이 연구는 집회시위에 대한 경찰의 대응방식과 관련하여 주최자, 일반시민, 그리고 경찰관의 인식태도를 비교, 연구하여 보다 합리적인 집회시위 관리방안을 모색하고자 하였다. 연구 결과 이 연구는 주로 두 가지 측면에서의 결과를 도출할 수 있었다. 첫째, 응답주체별 인식태도의 분석에 있어 경찰과 시민은 전체적으로 의견이 상반되는 가운데, 일반시민의 의견이 매우 중요한 역할을 한다고 보였으며, 이에 따라 일반인들의 시각을 통해 향후 집회시위의 대응기준을 설정하는 것이 바람직 할 것이라는 결론이 도출되었다. 둘째, 보다 합리적인 집회시위의 관리방식에 관한 것으로서, 이 연구의 조사결과를 토대로 방안을 도출해 보면 먼저, 법률적 기준에 입각한 경찰의 대응원칙 준수가 필요하고, 대응 경찰관들에 대한 통제강화와 더불어 처우의 개선이 동시에 이루어져야 한다. 또한 우리 사회의 주체는 시민이기 때문에 이들에 대한 법익보호와 시민참여의 활성화가 이루어져야 할 것인데, 이를 위한 방안으로는 지역연합체를 구성하여 활성화하고, 대규모 집회시 위원회 심사제의 도입과 시민참관단 제도를 보다 활성화해야 할 것이다.

영문 초록

The purpose of this study is to suggest the effective strategies for the police to control assembly and demonstration. The result of this study relies upon the comparative analysis of perception of assembly and demonstration organizers, citizens, and the police officers. This study shows two noticeable results. First, in the analysis of respondents' perception of assembly and demonstration, the citizens' perception makes an important role in the direction of assembly and demonstration, while citizens and the police have different views of assembly and demonstration. This result draws a conclusion that it seems to be desirable to develop the police strategies in the citizens' points of view. Second, for more effective and efficient control of assembly and demonstration, the result of this study suggest that it should be necessary for the police to keep the rules of engagement strictly. The result also shows that it is necessary to strengthen the control of the police officers who confront demonstrators, and to improve working conditions of the police officers, particularly the riot police. More importantly, the citizens' rights should be protected and the citizens' participation should be encouraged in the process of the control of assembly and demonstration. To this end, it seems to be desirable to establish the citizens' regional association for the control of mass assembly and demonstration. It seems to be also necessary to introduce the citizens' inspection committee and to activate the citizens' witness group for the effective control of mass assembly and demonstration.
