집시법 판례의 동향과 선진 집회ㆍ시위문화 정착의 과제

국문 초록

사회적 약자나 소수자가 사회를 향해 자신들의 의견을 표현할 수 있는 유일한 방법이 집회와 시위이다. 나의 생각, 나와 다른 목소리를 낸다는 이유만으로 소수자나 사회적 약자들의 집회ㆍ시위를 부정적으로 바라보는 것은 민주주주의 정신에 부합되지 않는다. 폭력적 집회ㆍ시위 등 불법한 집회ㆍ시위는 사법판단의 대상이 됨이 확실하나 그만큼 적법하게 이루어지는 집회나 시위는 최대한 보장되어야 한다. 집회ㆍ시위의 문제는 우리 헌법재판소가 판단하고 있는 바와 같이, 민주주의의 신장을 위해 위축시켜서는 안 될 기본권으로 보호해야 하는 동시에 집단행동의 속성상 의사표현의 수단으로서 공공의 안녕질서나 법적 평화와 마찰을 빚을 가능성이 큰 것 또한 사실이다. 최근 발생하는 집회ㆍ시위는 다각적인 관점에서 다양한 문제들이 발생하고 있다. 이를테면 1인 시위에 관한 문제, 플래시 몹(Flash mob)에 관한 문제 그리고 복면시위와 위장집회 혹은 유령집회의 문제와 야간집회금지의 위헌결정, 미신고 옥외집회 등에 대한 문제들이다. 집회ㆍ시위를 둘러싼 이러한 문제들은 비단 어제 오늘의 문제만은 아니다. 선진 집회ㆍ시위문화의 정착을 위한 노력의 일환으로 야간 옥외집회 위헌결정에 있어 조속한 입법개정을 통해 입법공백에서 오는 문제를 해결하고, 변형된 1인 시위나 플래시 몹 등의 새로운 시위형태에 관해서는 공신력을 가진 가이드라인의 제시와 의사표현방식의 새로운 수단의 필요성을 확인하였다. 또한 적법한 집회ㆍ시위의 적극적 보장과 불법한 집회ㆍ시위에 대한 엄정한 법집행이 필요하며, 법치주의의 확립과 사회지도층의 투철한 준법정신이 중요한 요소라 할 수 있다. 본고는 집회ㆍ시위와 관련하여 대법원과 헌법재판소의 판례를 바탕으로 최근 집회ㆍ시위에 관한 법률적 동향에 대해 살펴보고 집회ㆍ시위의 현상과 집회 및 시위에 관한 법률의 문제점을 짚어본 뒤 집시법의 개선방안과 이해갈등에 대한 문제해결 시스템 마련 등 집회 시위와 자유에 관한 문제들을 논의하였다.

영문 초록

The only way of the second-class citizen or minorities to express their opinions to the society is assembly and demonstration. The viewpoint to consider the assembly and demonstration of minorities or the second-class citizen negative due to different claims of ours is not compatible to the spirit of democracy. It is sure that illegal assembly and demonstration such as violent assembly and demonstration becomes the object of judicial judgment but legal assembly and demonstration should be guaranteed as much as it is. As our constitutional court judges assembly and demonstration, it is the fact that assembly and demonstration should not whither for the extension of democracy but be protected as basic rights and has the big possibility to have conflicts with public peace and order or legal peace as a means of opinion expression due to its property of group behavior. The recent assembly and demonstration causes various problems in diverse viewpoints. For example, they are the issues of single person demonstration. flash mob, mask demonstration and disguise assembly or phantom assembly and unconstitutionality decision of night assembly prohibition and unreported outdoor assembly. Assembly and demonstration have been the issues of our society. As an effort to settle the advanced assembly and demonstration culture, it solved the problem of legislation vacuum through prompt legislative revision of the unconstitutionality decision on the night outdoor assembly and confirmed the necessity of suggestion of a guideline with public confidence about new demonstration types such as transformed single person demonstration or flash mob and new methods of opinion expressions. Based on the precedents of the Supreme Court and the Constitutional Court related to assembly and demonstration, this paper examined the legal tendency of the recent assembly and demonstration and reviewed the phenomena of assembly and demonstration and the legal problems on assembly and demonstration law and discussed problems on assembly and demonstration and freedom such as the preparation for a problem solving system about the improvement and conflicts of interest of assembly and demonstration act.
