국문 초록

국민의 생명과 건강의 안전을 위한 국가의 개입은 단순히 질서행정의 범위를 떠나 리스크 및 위험관리를 주목적으로 하는 것으로, 규제ㆍ유도 또는 조장 등의 수단으로 적극적인 목적의 질서를 형성하는데 그 중점이 있는 것이므로 위험의 존재가 예측ㆍ발생되기 훨씬 이전의 단계에서 취해져야 할 필요가 있다. 따라서 보다 안전한 환경을 위한 안전관리시스템을 더욱 공고히 하기 위해서는 위험을 포함하여 체계적으로 관리하는 규범적 노력이 필요하다. 그런데 안전을 위협하는 발생가능한 모든 위험이 있는 행위에 대하여 적극적으로 개입하여 위해발생이라는 결과를 막기 위한 사전적 필요조치를 할 수 있기 위해서는 무엇보다도 법률에의 근거규정이 필요하다. 그렇게 하는 것이 현대사회의 각종 위험의 다양성 및 안전을 특히 강조한 현대행정의 임무와 권한의 상대성에 입각하여 입법취지와 법률유보의 원칙에 따른 법치국가원리에도 부합되는 것이기 때문이다. 물론, 위험의 개념은 불확실성을 직접 규율대상으로 하는 것이므로 위험은 확률적 개념에서 접근하여 시스템적으로 낮추어야 하는 것이지 법의 내용을 강화한다고 하여 근본적으로 없어지는 것은 아니라 할 수 있다. 그러나 현대 위험사회의 안전성확보를 위한 위험관리시스템 역시 법적 근거를 전제로 할 것이므로 구체적으로 실정법에 그 근거가 필요하다고 보는 것이다. 어느 표현이든 국민의 생명과 건강에 대한 위험의 개념은 그 파악되는 방향이 조금 넓게 해석되는 경우도 있다. 그러나 법의 성격상 규정의 입법취지가 무엇인가를 고려하여 규제의 가부를 결정할 것이므로 일선 안전집행기관은 법 규정이 없다는 점을 들어 그 입법목적에 충실하게 소극적으로 집행할 소지가 많다. 또한 법적인 취급대상 및 평가에 있어서도 위험이 행정청의 판단여지로 인정된다 하더라도 법원에 의한 통제밀도가 축소되는 것이 아니라, 오히려 판단여지로 인하여 행정청에게 이유제시와 설명의무의 부담을 증대시키기 때문에 더욱 그러하다.
