국문 초록

오늘날 우리나라의 엔터테인먼트산업은 전례가 없을 정도로 눈부신 발전을 하고 있다. 하지만 엔터테인먼트산업의 지속적인 발전을 위해서는 주의하거나 개선하지 않으면 안 될 사항이 있다. 본 논문에서는 엔터테인먼트산업의 지속적 발전을 위해서는 어떤 조건이 갖추어져야 할 것인가에 관해서 2가지 헌법문제를 고찰하였다. 그 하나는 엔터테인먼트 산업의 문화국가원리에의 적합성에 관한 문제이다. 엔터테인먼트산업이란 일종의 문화산업으로서 국가의 문화정책과 깊은 관련이 있다. 따라서 국가가 바람직한 문화정책을 시행하지 않는다면 엔터테인먼트산업의 발전에 영향이 클 것이라는 점이다. 여기에서 바람직한 문화정책이란 헌법의 기본원리인 문화국가원리에 충실한 정책을 의미하는 데, 그것은 바로 국가의 '문화의 자율성 보장'과 문화영역에의 '국가의 관여'의 문제이다. 다른 하나는 엔터테인먼트 산업에 종사하는 엔터테이너의 인권보호에 관한 것이다. 특히 인권사각지대로 불리는 연예계에 종사하는 연예인의 인권침해는 엔터테인먼트산업 발전을 위해서도 반드시 해결해야 될 문제로서, 여기에서는 연예인의 인권상황과 인권보호제도에 관해서 고찰하였다.

영문 초록

This article explores on the constitutional viewpoint about what condition will be prepared for the growth of entertainment industry. these days, the entertainment industry of South Korea unprecedentedly has made startling progress. but for the continuous growth of the entertainment industry, there are some essential particulars that have to pay attention and to improve. One thing is that the nation must enforce cultural policy to be desired, because the entertainment industry is closely related to the cultural policy of nation. therefore, the cultural policy of nation has to suitable to the principle of cultural state that includes the guaranty of cultural self-regulation and the national obligation such as the protection, the promotion and the restriction of culture. Another is the matter to the protection of human right of entertainers attending to the entertainment industry. here, this study considers the situation, the protection system and its improvement of the human-right of entertainer.
