재외국민 선거의 편의성과 공정성 확보방안에 관한 연구

국문 초록

헌법재판소는 주민등록 여부에 따라 선거권 자격을 결정하거나, 국내 거주자에 대해서만 부재자신고를 허용하는 것은 재외국민의 선거권 행사를 전면적으로 부정하게 되어 재외국민의 선거권ㆍ평등권을 침해하고 보통선거원칙에 위배한다고 판단하여 종전 입장을 변경하였고, 2009. 2. 12. 공직선거법 개정으로 재외국민 선거제도가 도입되었다. 대부분의 재외국민들은 참정권 보장에 따른 정치적 위상의 제고와 권익 확보의 기회 마련에 대하여 크게 환영하는 분위기인 반면, 개정 공직선거법상 지역구 국회의원 선거권이 일부 제한되고 투표방법을 공관투표에 한정하고 있는 점 등에 대하여 불만의 제기가 있으며, 일각에서는 재외국민들이 국내 정치에 관여함에 따라 체류국 사회에서 주류로 성장하는데 장애요인이 될 수 있고, 이념ㆍ파벌에 따른 교민사회의 분열 심화, 선거부정 여지 등을 이유로 우려를 표명하고 있다. 이 논문에서는 재외선거인의 투표참여 편의성 제고방안을 살펴본 후, 재외선거의 절차적 공정성 확보방안과 재외선거사범에 대한 정책방안, 재외선거사범 대응 체계 및 문제점, 수사ㆍ공판 관련 입법론적 대안 순으로 재외선거의 쟁점들을 검토하고 있다. 내년 제19대 국회의원 선거와 제18대 대통령 선거에서는 본격적인 재외선거제도가 도입되는바, 이는 우리나라 민주주의가 한 단계 도약하는 역사적인 전환점이 될 것으로 보인다. 그러나 우리나라의 주권과 사법권이 미치지 않는 지역에서 이루어지는 재외선거에서 재외선거의 공정성이 확보되지 못할 경우 선거 전체의 공정성에 대한 논란이 발생할 수 있다. 이를 사전에 방지하기 위하여 선거관리위원회는 금년 1월 선거관리의 경험과 전문지식이 풍부한 정예직원 55명을 외국의 주요 공관에 파견했다. 파견된 직원들은 재외선거의 공정성을 확보하기 위한 중요한 인적 기반의 역할을 하게 될 것이다. 즉 전문성을 갖춘 직원의 현지 상주만으로도 법과 제도의 미비점을 이용하여 발생할 수 있는 재외선거범죄를 억제하고 예방하는 역할을 할 것으로 기대된다. 재외선거와 관련하여 투표종사자에 대한 연구나 교육은 매우 중요하다. 선거는 국민의 기본권으로 헌법이 보장하고 있고, 권리행사가 침해되면 선거자체가 무의미해지기 때문이다. 재외선거는 국내에서의 선거업무와는 달리 외국에서 이루어지기 때문에 투표종사 경험이 전무한 사람들이 투표종사자로 참여한다. 따라서 이들에 대한 교육은 매우 중요하다. 재외선거에서 홍보활동은 지역에 따라서 매우 상이하다. 미디어도 매우 제한적이다. KBS World나 라디오방송인 한민족 방송, 민간방송은 Arirang TV 등을 통한 홍보방안을 강구하는 것이 효율적일 것으로 보인다. 이와 아울러 교민단체나 교민언론, 상공회의소 등 교민 네트워크를 활용하는 방안이 마련되어야 할 것이다.

영문 초록

The Constitutional Court changed the decision that resident registration is precondition of the right to vote or only domestic residents can cast an absentee vote. This is unconstitutional, because it is strongly denying the right to vote of korean residents abroad, and it is against the principle of popular election, right to equality. So, the election system of korean residents abroad is imposed through revision of public offices election law in 2.12.2009. Almost korean residents abroad welcomed improvement of political status and right to ensure a chance through guarantee the franchise. But there are dissatisfaction that revision of public offices election law restrict the right to vote in local election of members for the National Assembly, and a method of voting is limited in a diplomatic offices in the foreign country. Some say korean residents abroad are difficulties into the mainstream society in the country, because of participating in domestic politics. And factional strife ideology, illegal electioneering will bring out the division of overseas korean society. This paper, first, consider the matters of convenience in the voting of korean residents abroad. Secondly, the plan of procedural fairness in the election of korean residents abroad, and the plan of regulation illegal election activities. The third time, the problem and controlling system of election illegalities. Finally, the alternative of de legal ferenda associated with investigation and trial. Next year, Korean Residents abroad can through a vote for the 19th National Assembly and the 18th President election. It shows a spring of democracy to us and means historical turning point of democracy. But it causes controversy about fairness in the Election of Korean Residents abroad, because this election is beyond our sovereignty and judicial power. For a preliminary prevention this problem, National Election Commission dispatched 55 members of the staff who have a expert knowledge and experience of election administration to major foreign official residence in January this year. 55 members of the staff dispatched will play the role of locomotive for secure a fairness in the Election of Korean Residents abroad. If the staffs dispatched are stationed at major foreign official residence, election crimes overseas which could happen are prevented from taking advantage of loop holes in the law. With reference to the election of overseas, research and education is very important for vote practician. The constitution ensure the right to vote with a human right. If infringe on the rights, it is meaningless. So education of vote practician is very important. Publicity activities are very different from every region in the election of overseas. Media is limited in terms of both quality and quantity. It is effective that KBS World, the Korean race broadcasting and civil broadcasting inform this through Arirang TV. Also the plan on the utilization of overseas Korean network is more than necessary, for example overseas Korean association, overseas Korean media and The Chamber of Commerce and Industry.
