인권조례 제정 동향과 향후 과제

국문 초록

최근 우리나라 몇몇 지역에서 인권조례 제정 운동이 확산되고 있다. 광역단위에서는 광주광역시, 경상남도, 전라북도에서 각각 인권조례가 제정되었고, 기초자치단체에서도 부산광역시 남구, 해운대구, 수영구 그리고 울산광역시 북구에서 인권조례가 제정되었으며, 이러한 조례 제정 움직임은 각 기초자치 단체로 확산되어 가고 있다. 그러나 우리나라 지방자치 차원의 인권조례 제정 사례 수는 여전히 미흡한 편이다. 국가의 법률이 있음에도 불구하고, 지방자치단체에서 조례를 제정하는 것은 각각의 지방특색에 따른 조례를 통해 인권향상을 위한 사회기반정비와 개선을 구체적으로 추진하는 것이 가능하기 때문이다. 따라서 각 지역 특색에 걸맞은 구체적이고 실효성 있는 인권조례를 만드는 것이 무엇보다 중요하다. 인권조례 제정에 있어서 가장 중요한 것은 외형적인 제도 마련으로 접근하는 것이 아니라 인간의 존엄을 실현하기 위해 각 지역사회에서 어떻게 인권의 기준을 세울지 고민하는 작업이 선행되어야 한다. 각 지역에서 만드는 인권조례는 인권관련법의 실핏줄 역할을 하며 지역 주민들의 인권 보호와 증진을 위한 중요한 통로가 된다. 그뿐만 아니라 인권현실 개선을 위해 지방자치단체 및 지방의회의 역할을 구체적이고 세밀하게 규정함으로써 지역 책임기관의 의무와 책임의 범위를 넓힐 수 있다. 본 논문에서는 이상의 논점을 중심으로 한국사회에서 인권조례 제정 추진이 부진한 이유를 살펴보고, 현재 진행되고 있는 인권조례 제정의 동향과 조례 제정 과정에서의 주요 쟁점을 고찰하는 한편, 향후 조례 제정 및 시행 과정에서 풀어나가야 할 과제를 고찰해 보았다. 다행스럽게도 최근 많은 지방자치단체에서 각 지역의 특성을 반영하면서 인권의 보편적 가치를 존중하고 이를 지역에서부터 실천하고자 하는 구체적인 움직임이 확산되고 있는데, 인권조례의 실효성을 담보하기 위해서는 지역사회의 특성과 정책, 그리고 적극적 조례 제정운동의 결합이 연계되어야 한다. 절차적으로는 지역 사회의 인권 단체와 시민사회의 적극적인 문제제기, 일반 주민의 참여, 지자체와 지방의회의 수용이 순조롭게 진행되어야 하며, 내용적으로는 조례내용의 실효성 및 다양성 확보, 지자체의 적극적인 실현 의지 등이 뒷받침되어야 한다.

영문 초록

This study is focused on the movement on the enactment of human rights ordinance in local community and on several tasks to be solved to establish more human rights ordinances nationwide. Recently, some local governments including Kwangju metropolitan city have tried to enact human rights ordinance, whatsoever the contents and structures of the ordinances are various on the basis of the characteristics of local community. However, compared with Japan’s cases on the human rights ordinances, the number of Korean cases are still smaller. Human rights ordinance needs to reflect the characteristics and interests of local government to expand the human rights of residences who have lived in the region. Therefore, human rights ordinance can help to promote and protect human rights of vulnerable group, which can be neglected due to priority of human rights policy enacted by the related laws nationwide. Recent experiences of human rights cities tend to revitalize human rights ordinance within the context of local politics. However, sociological imagination remains to be fully further explored to grasp genuinely bottom-up aspect of human rights promotion in our society. Regardless of legal foundation and dignity of human rights itself, there are some reasons why it is hardly to enact human rights ordinance by local government. One of main reasons is that administrative powers and local council have not understood social significance of human rights and its ordinance as a systemic mechanism. This study is trying to analyze the reasons of insufficient tendencies on establishment of human rights ordinances, and to approach the current movement on the enactment of human rights ordinances of selected local governments, and to several key issues remained in the process of enactment of human rights ordinances as well as the tasks to overcome to spread the movement on establishment of human rights ordinance in the future. To guarantee the effectiveness of human rights ordinance, on reflection of characteristics local community, stake-holders including positive policy-making of local administrative government, active role of local parliament members, enthusiastic participation of citizen and continuos coordination by non-government organizations are needed to be closely connected to the movement on establishment of human rights ordinance.
