자살시도자에 대한 경찰의 적절한 대응에 관한 연구

국문 초록

자살의 최고위험군은 자살을 기도하였었던 자살시도자이다. 대다수의 자살시도자는 인생의 실패를 해결하기 위한 마지막 선택으로 자살을 택하기 보다는 타인과의 강력한 소통을 원하는 사람임을 알수 있다. 소통적 자살 개념을 통해 경찰이나 관련 기관의 활동에 따라 충분히 자살을 예방할 수 있다. 자살시도자에 대한 보호조치를 규정한 「경직법」 제4조가 있음에도 이를 활용하지도 않고, 그 시행령에서는 구호기관에 신병을 인도한 경우 자살시도자의 인적사항을 제공할 수 있는 법적이 근거가 있으나, 실무에서는 전혀 이용치 않고 있다. 경찰에서 기존에 소극적으로 대처해 왔었던 것과 달리 자살시도자에 대하여 적극적으로 대처하여 우선적으로 생명을 구호하고, 자살예방센터 등 구호기관에 자살시도자와 보호자의 인적사항 등 자료를 제공하고, 응급을 요하나 경제적인 빈곤이 있는 경우에는 치료비도 지원받을 수 있는 터전을 마련해 주어야 한다. 자살은 형사처분의 대상이 아니라서 형사정책의 주 관심대상이 아니었다. 그러나 범죄자와 범죄피해자의 자살문제와 유명인의 자살을 통한 세간의 관심의 집중 등 자살은 문제성 있는 사람들만의 문제가 아닌 사회 전반적인 문제로 대두되었다. 우선적으로 경찰에서 보호조치의 대상으로서 자살시도자와 보호자에 대하여 생명을 구호하고, 계속될 것으로 예상되는 자살시도를 막기 위하여 전문기관과의 협조가 필수적이라 할 것이다. 이러한 변화된 환경 속에서 자살은 이제 국가 형사사법기관이 시급히 해결해야할 형사정책의 문제로 대두된 것이다. 우선적으로 보호조치의 대상 중 자살시도자에 대해서는 강행규정으로 경직법을 개정하고, 시행령에서 자살시도자와 신고자에 대한 자살시도 당시의 상황과 인적사항 등을 정신보건센터 등에 제공할 수 있는 법적인 근거를 마련해야 한다.

영문 초록

Parasuicide is the biggest indicator for a future successful suicide attempt. Studies have found that most of those who commit suicide have a history of parasuicide. Indeed, suicide attempts that do not result in death are much more common than completed suicides. Many of these attempts are carried out in a way that makes rescue possible. The usual attempt may be a wish to affect another person by the behavior. Consequently, it occurs in a social context and may represent a request for help. In the sense, such suicide can be named as 'communicative suicide.’ Given that most successful suicide is preceded by a few (10 times or so) failed suicide attempts and that the suicide attempt has communicative aspect by someone who is in desperation, we could prevent a large portion of successful suicide attempts in advance if the police would have responded more appropriately and actively to those who had attempted suicide in the recent past. Currently, however, the police has been doing things on very negative lines. Though the police may provide some personal information about those who attempted suicide to managed care organizations or other health related agencies if it delivered them to the organizations, the police has not provided them at all. Moreover, under the current statute and regulation, the police can’t provide some personal information about those who attempted suicide to a health related agency unless the police delivered them to the organizations and it got informed consent from those who attempt suicide about the provision of their personal information. Without such basic information, some programs conducted for the prevention of suicide by other government agencies, like the Ministry of Health and Welfare, would be unsuccessful or at least very inefficient. It may be difficult for such agency to spot people to be the subject of its program for suicide intervention, like consultation. Considering suicide is a serious problem but it may be abated through effective response to the request for help by those who made failed suicide attempt, the police should take more active intervention against parasuicide. The police should provide their personal information, including basic information on their parents, guardian or spouse, to the public care organizations, regardless whether it would hand those over to the organizations. The requirement of informed consent for purveying such information should also be eased to be replaced by consent of parents or spouse in some cases. Hopefully, the information would lead to more effective consultation or other treatment by health related agencies or organizations. If needed, the government may pay for even their medical expenses in some cases. Suicide is one of the leading causes of death in South Korea, but relatively it has not got wide attention from the authorities concerned and the academia of criminal policy. The issue of suicide comes to the fore as some celebrities killed themselves in recent years and suicide finally begins to be recognized as serious problem for our society at large, not just for some outsiders or “losers.” Under such circumstances, suicide becomes the matter that must be settled urgently by the legal authorities. The police should give priority in expanding cooperative work with specialized care related agency or other health agencies to avoid future successful suicide attempt and other suicidal behaviors.
