통감부의 조사사업과 조선침탈

국문 초록

이 논문은 일제가 1905년 을사조약 이후 통감부를 설치하면서 농업과 수산업 조사를 행하고, 부동산과 관습조사를 행하면서 조선을 침탈해가는 과정을 밝힌 글이다. 일제는 1904년 5월말에 〈대한방침 및 대한시설강령〉에서 한국을 병합하는 계획을 세웠고, 러일전쟁에서 승리한 이후 영국과 미국 및 러시아 등 열강들에 의해 조선의 독자적 지배를 인정받자, 본격적으로 식민지화해가는 작업을 추진해 갔다. 일제는 조선의 식민지화 계획을 구체화하기 위하여 각 영역별로 기존에 행해왔던 조사 작업을 종합 정리하여 조선의 실상을 파악하고, 그것을 바탕으로 조선의 침략을 본격화하는 작업을 추진하였다. 먼저 산업부문에서는 농업과 수산업이 중심이었다. 1894년 청일전쟁에서 승리한 이후, 일본 상인들과 일본 지주 및 농민들이 조선에 몰려들기 시작하였다. 일본은 이들이 조선에서 이익을 얻거나 성공적으로 정착하기 위해 조선의 상행위 관행이나 소작관행 등을 조사하여 정보를 제공하였다. 일본정부는 1889년 「조일통어장정」을 맺어 일본 어민들이 조선 연해에 본격적으로 진출하게되자 조선 연안의 사정을 파악할 필요가 있었다. 그리하여 1892년에 일본의 수산전문가에게 의뢰하여 조선 연해를 조사·보고하도록 하였다. 그 뒤 일본의 지방정부와 일본인 수산단체에서 조선연해 조사보고서를 많이 발간하여, 일본 어민들의 조선 진출을 도왔다. 통감부에서는 5개년에 걸쳐 조선의 수산업을 전면적으로 조사하여 방대한 『조선수산지』(1908∼1911)를 발간함으로써 일본 어민의 조선 진출을 독려하고, 조선 어업을 장악해가는 기초자료로 활용하였다. 일제가 조선을 식민지로 지배하고 일본인의 조선진출을 촉진하기 위해서는 조선의 토지제도 및 토지소유권의 종류 및 권한 행사 등을 알아야했다. 伊藤博文 통감은 1906년 부동산법조사회를 설치하고, 일본의 부동산법 전문가이면서 동경대 법학교수인 梅謙次郞을 초빙하여 회장으로 임명하고 조선의 부동산 관행을 조사하도록 하였다. 이 조사사업을 바탕으로 일본인에게 토지소유권을 보장해주는 법률을 공포하였고, 1910년 조선을 병탄한 이후 토지조사사업을 실시해갈 수 있었다. 통감부는 부동산법조사회의 활동을 계승하면서 그 조사범위를 확대한 법전조사국을 설립하여 조선의 토지 권리뿐 아니라 조선의 상관습 및 상속 등의 관행을 조사하는 관습조사를 행하였다. 이를 바탕으로 조선의 민사법을 제정하고 조선을 효율적으로 통치하고자 하였다.

영문 초록

This paper illustrates how Japan did an survey on agriculture and fisheries after “Eulsa Treaty” in 1905. Not only that, it also shows the invasion process of Joseon by investigating real estate and custom. At the end of May 1904, Japan planned to annex Joseon in he 〈Policies and Facility Codes on Joseon〉. After Japan’s victory in Russo-Japanese Wars, Japan was admitted to dominate Joseon on its own way by the Powers such as England, United States and Russia. Consequently, Japan was able to embody the colonization of Joseon. Japan colligated many different kinds of established data in every field to embody the plan of colonization in Joseon. First, the agriculture and fisheries were the center of the industry. After Japan won at First Sino-Japanese War in 1894, Japanese merchants, landowners and farmers started to gather in Joseon. Japan provided all the information on Joseon’s custom of commercial activities and tenancy practices to them to make profits and settle down successfully. In 1889, Japanese government made up the 〈Fisheries Agreement between Joseon and Japan(朝日通漁章程)〉treaty to grasp the circumstances of Joseon’s coast. Thus, it asked the professional in the field of fisheries, to investigate and report on Joseon’s coast. After that, Japanese municipals and association of fisheries helped Japanese fishermen to advance into Joseon by publishing reports of Joseon’s coast diversely. To colonize and to promote the inroads of Japanese into Joseon, Japan needed to know the land system and kinds of land ownership. A Resident-General Ito Hirobumi(伊藤博文) established the Real estate legal community in 1906, invited Ume Kenjiro(梅謙次郞), a doctor of laws at Tokyo University and specialist on laws of real estate, and appointed him as a president to examine Joseon’s practices in realty. Based on this survey, not only the Residency-General promulgated laws for Japanese to guarantee land ownership, but also conducted land survey after 1910. The Residency-General not only succeeded in Real estate legal community’s activity but also established the research bureau of law books, which enlarged scope of investigation. From that, the Residency-General not only investigated land ownership of Joseon, but also investigated a commercial practice and inheritance of Joseon. On the base of investigation, the Residency-General enacted the Civic Codes in order to govern Joseon effectively.
