프랑스와 한국의 건축허가에 관한 비교법적 고찰

국문 초록

건축허가는 건축물을 신축하거나 기존 건축물에 일정한 변경을 가하기 전 그것이 관계 법령에 합치하는지에 관하여 허가권자가 심사를 거쳐 교부하는 일방적인 행정행위를 말한다. 우리나라의 건축허가는 건축법에 근거를 두고 있는 데에 반하여, 프랑스의 경우 그 근거를 도시계획법에 두고 있다는 점에서 가장 큰 차이가 있다. 다시 말하면, 한국의 건축허가는 국토의 계획 및 이용에 관한 법률과 건축법이 정하는 허가요건을 충족하는 것을 전제로 건축법이 정하는 절차에 따라 심사되고 교부되지만, 프랑스의 건축허가는 건축 및 주거법전이 정하는 건축기술적 요건과 도시계획법전 상의 도시계획적 요건을 충족하는 경우 도시계획법전이 정하는 절차에 따라 교부된다. 프랑스 도시계획법전은 2000년 이후 몇 차례의 개편을 통하여 국토의 균형적인 발전과 합리적 이용을 위하여 도시계획에 대대적인 변경을 가하여 왔으며, 2005년 12월 8일자 오르도낭스(Ordonnance)와 2007년 1월 5일자 데크레(Décret)는 도시계획법전에 근거를 두었던 11개의 허가유형을 3개의 허가(건축허가, 개발허가, 철거허가)로 대폭 변경하였다. 이는 허가의 대상을 재정비하고, 절차에 있어 기간과 방식 등을 구체화 내지 명확화 함으로써 행정청의 자의를 최소화하기 위한 것이었다는 데에 의의가 있다. 2008년 이래로 프랑스는 “지속가능한 발전”을 구체화하기 위해 관계 행정부처를 통합 및 재편하였고, 그에 관한 일련의 법(소위 환경그르넬법)을 제ㆍ개정하고 있다. 예컨대, 도시계획분야에 있어서는 다양한 지속가능한 도시계획기법을 제안하고 있으며, 건축분야에 있어서는 에너지소비저감건축 내지 친환경건축을 위한 기술적ㆍ규범적 요건을 마련하여 시행하고 있다. 프랑스 도시계획법전 상의 건축허가요건이 보다 친환경적인 입장에서 매우 구체적인 방식으로 규정되고 있는 동향을 살펴보는 것은 우리나라 건축허가제도의 발전에 시사하는 바가 있을 것이다.

영문 초록

Construction permit is, before a building is constructed or a certain change is put on it, the administrative activity the authorities concerned grants to a construction proposal after examining whether it satisfies the requirements of concerned laws and ordinances. The biggest difference in the construction permit of Korea and France is that, while the former is based on the construction law, the latter is on the urban planning law. In other words, the Korean construction permit is to examine a construction proposal and decide whether to give permit or not to it following the procedures of the construction law, on the premise that it satisfies the permit requirements prescribed in both the law on territory planning and use and the construction law. In the French case, however, the permit is given following the procedures stipulated in the code of urban planning laws when a proposal satisfies both the construction techniques requirements in the code of construction and residence laws and the urban planning requirements designated in the code of urban planning laws. Since 2000, France has made big changes in urban planning toward more balanced development and reasonable use of its territory through several revisions of the code of urban planning laws. For example, the Ordonnance on December 8th, 2005 and the Décret on January 5th, 2007 downsized the thirteen permission types based on the code of urban planning laws into three types(construction permit, development permit, demolition permit). It is meaningful in the sense that they were designed to rearrange permission objects and minimize arbitrariness of administrative authorities by specifying or clarifying periods and methods of procedures. France, to realize "sustainable development," has merged and reorganized related administrative departments and agencies, and newly established or revised a series of laws(the environment Grenelle law) since 2008. For instance, in the urban planning area, various urban planning techniques for sustainable development have been suggested, and, in the construction area, technical and normative requirements for reducing energy use and realizing environment-friendly construction have been prepared and enforced. It seems to imply something to the development of Korean construction permit system to look into the recent movements in France that construction permit requirements have tended to be stipulated in very specified ways toward environment-friendly direction.
