지적공부의 신뢰성 확보를 위한 제도적 개선방안

국문 초록

현재 통합 된 측량․수로조사및지적에관한법률에서는 토지이동 시 그 신청의무기간을 60일 또는 90일로 적용토록 규정하고 있으나 토지이동의 의무위반에 따른 과태료의 범위나 과태료의 부과기준 등의구체적인 세부조항 규정을 별도로 두지 않고 있다. 본 연구는 이러한 법․제도적인 문제를 바탕으로 지적공부의 최신성 및 신뢰성을 평가하기 위해 실제 이용상황과 지적공부와의 부합여부를 Google Earth영상을 통해 평가하였고 전문가와 일반인을 대상으로 지적공부의 신뢰성을 평가하였다. 분석결과 전체총 120필지 중 불부합 필지는 Google Earth를 통한 육안분석은 6필지, 토지등기부 4필지, 건축물대장 3필지로 확인되었고, 신뢰성의 유지 및 확보를 위한 방법으로 의무신청기간의 폐지는 52.5%, 과태료 부과를 위한 법․제정안의 필요는 44.75%, 건축물의 인․허가 준공 신청 시 지목변경 동시신청은 90.5%,담당공무원의 직권처리방안은 85.3%, 업무연계를 통한 토지이동알림서비스와 같은 대민행정서비스 병행실시는 81%, 자연재해로 인한 불부합 발생 시 지목변경 특례규정 마련은 71%로 분석된 결과를 토대로 법․제도적인 개선방안을 제시하였다. 향후 지적공부 관리의 신뢰성을 위한 법․제도적인 수정 및보완에 있어 기초적인 참고자료로써 활용할 수 있을 것으로 판단된다.

영문 초록

According to the combined law of relate with survey, waterway and cadastral that is not exist on the criterion of penalty deadline of obligation in the concrete for land alteration within 60days and 90days. This study analyzed of non conincidence to land category using Google Earth between real conditions and cadastral record with legal basis that was bring about more decrease of cadastral record of accuracy or reliability. As a results, Analysis of Google Earth image with a naked eye was confirmed non conincidence of land category 6 parcel, on the basis of cadastral record attribute were confirmed land register 4 parcel, building register 3 parcel for non conincidence of land category in the 120 parcel. also, we evaluated to improvement of related regulations with questionnaires for 2 parts of experts and common person. In case of experts group was investigated that the abolishment of deadline for obligation application was at 52.5%, the enactment of penalty levy for land alteration was at 44.75%, the legislation for the submit an application concurrently in building completion with land alteration were at 90.5%, the enactment of process according to the public official authority was at 85.3%, the legislation for the inspection of completion and notification service to progress concurrently were at 81%, the enactment for the non-conincidence of land category by natural disaster was at 71%. The outcomes of this study will contribute to accommodate the rule of amendment or criterion as reference data for reliability of cadastral record management
