국문 초록

부동산등록 공시제도는 부동산의 물리적 현황과 권리관계를 명확히 공시하여 효율적인 토지관리 및소유권보호에 기여하고, 부동산 거래의 안전성과 신속성을 보장하고 국토이용계획 및 토지정책수립에필요한 기초자료와 정보를 제공하는 기능을 한다. 우리나라의 부동산공시제도로서 지적제도와 등기제도가 있으며 양 제도는 동일 토지를 대상으로 하고 있을 뿐만 아니라 서로 유기적 상관관계를 맺고 있으면서도 두 제도의 이원화로 인해 발생하는 문제 즉 지적공부와 등기부 사이에서 서로 중복되어 기재되는 사항이 있게 되는데 동일사항이 두 공부에 기재되므로 인하여 서로 일치되지 않는 사항이 발생하게 된다. 그로 인해 상당한 불편과 재산의 손실 또는 행정과 인력의 낭비를 초래하고 있음은 물론 국민의 사권보호와 국민의 법령집행과정에 있어서도 많은 문제점을 야기하고 있다. 따라서 본 연구에서는부동산등록 공시제도의 이원화로 인한 공시사항의 중복과 공부상의 내용과 실체상의 내용 불부합을 방지하기 위하여 지적과 등기를 일원화 하는 방안을 제시하고자 하였으며 이를 위한 방안으로 공시법령의 정비, 지적재조사사업의 실시, 지적공부와 등기부의 통합, 관리체계의 정비등을 제시하였다.

영문 초록

A real estate public announcement system is not to contribute effective land management and protection of ownership in order to announce physical condition and rights of real estate, but also to provide essential basic data and information for establishing the state land use plan and the land policy based on security and promotion of real estate transaction. As a real estate public announcement in Korea, there have been a cadastral system and a land registry system. Those systems have been managing and operating for same land parcels based on closed relationship. However both systems have severe problems as operating dual systems. If two system should be included same data for land data, they manage and show different data in certain cases. As a result, these problems are caused the loss of property or the squandering of the nation's resources as well as problems for rights security and an unsuitable order of execution. Thus this paper is to introduce improvement of public announce system, implementation of cadastral resurvey project and integration of cadastre and land registry, setting of management system for preventing problems of dual systems such as duplication of data, disparity between real situation and recording data in both systems
