지적재조사사업에 따른 청산방안에 관한 연구

국문 초록

본 연구목적은 1996년부터 내무부와 대한지적공사 및 국회에서 입안하였던 지적재조사특별법(안)을비교 검토하여 면적증감에 따른 청산방안을 제시하는데 있다.연구결과 지적재조사사업에 따른 창산방안은 첫째, 면적의 증감이 있는 경우에는 지적소관청이 주관하여 청산하는 것을 원칙으로 하고 둘째, 면적의 증감이 지적법령의 규정에 의한 허용범위 이내, 재산금이 일정 금액 미만, 소유자 동의가 있는 경우 등은 청산에서 제외하며 셋째, 청산 대상 토지를 최소화하도록 가칭 “지적재조사위원회”에서 경계에 관한 조정을 할 수 있도록 하고 넷째, 청산금 산정에 불복이 있는 경우에는 청산금의 재 산정신청을 할 수 있도록 지적재조사특별법(안)에 “청산의 원칙과 제외대상, 청산금의 산정기준과 방법, 청산금의 징수와 교부, 청산금의 재 산정” 등에 관한 사항을 구체적으로 규정하는 것이 바람직하다고 판단된다.그리고 지적소관청에 청산기금을 설치하고 먼저 면적의 감된 소유자에게 청산금을 교부하고 후에 면적이 증된 소유자로부터 청산금을 징수하도록 제도화하면 국가나 지방자치단체의 부담을 줄일 수 있으며 지적재조사사업을 안정적이고 지속적으로 추진할 수 있을 것이다.

영문 초록

The purpose of the present research is to suggest a liquidation method according to increase and decrease of the area by comparatively examining the Special Act on Cadastral Resurvey(draft) that drew up at the the Ministry of Home Affairs, Korea Cadastral Survey Corporation and National Assembly since 1996. As a result of a research, the liquidation method according to the Cadastral Resurvey Project is as follows. First, it is a rule that the Cadastral Competent Agency manages and liquidates in case of increase and decrease of the area. Second, when the increase and decrease of a area is within an allowable range by regulations of laws and ordinances on a land register or the liquidation money is below certain money or there is an agreement of a owner, etc., it is excluded from liquidation. Third, it is made that tentatively named “Cadastral Resurvey Committee” can adjust the boundary to minimize the liquidation target land. Fourth, when there is disobedience at calculation of liquidation money, the recalculation application of liquidation money should be possible. Accordingly, it is judged that what the item about "principles and excluding targets of liquidation, calculation criterion and method of liquidation money, collection and delivery of liquidation money and recalculation of liquidation money", etc, is specifically regulated in the Special Act on Cadastral Resurvey(draft) is desirable. And install the liquidation fund at the Cadastral Competent Agency, first deliver liquidation money to an owner with reduced area, and later, if it systematizes to collect liquidation money from an owner with increased area, the public appeal on liquidation is solved, and the burden of the nation and local governments can be reduced, and the Cadastral Resurvey Project can be promoted stably and continuously.
