영문 초록

A civil procedure proceeds to a final judgment. As a general rule, judgments come into existence through addressing of judicial opinions. It is needless to say that judgments come into existence orally without written judicial opinions. But, oral judgments should be filed by law clerks in order to come into effect. So, a judicial opinion occupies an very important position in civil procedure irrespective of judgment's form. The minimal requirements of judicial opinion is prescribed by statutes, and supplemented by practice of the courts in the Civil Law Tradition. In contrast, practice of the courts have developed almost all forms and contents of judicial opinions in the Common Law Tradition. The legal tradition and culture of a nation have filtered into the structure & style of its own judicial opinions. In addition, judicial opinions are the documents that judges make their own thoughts and beliefs clear about cases. Judicial opinions are the ways and means that judges communicate with society. So, the structure & style of judicial opinion is a mirror of the judge's individual character and personality. In short, a study on the structure & style of judicial opinions furnishes the method of evaluating judges' capacity as well as understanding legal tradition and culture. This article analyzes and estimates the structure & style of judicial opinions from a comparative perspective.
