일본의 헌법재판소설치 논의에 관한 연구

국문 초록

일본은 헌법 제76조 1항에 의해 최고재판소를 중심으로 사법권을 갖고 있고 일본헌법　제81조에 근거하여 재판소가 헌법재판의 권한을 갖는다.　 일본의 경우 1950년 이후 점진적인 헌법소송론의 발달을 통하여 하급법원의 다수 법률의 위헌판단 사례가 있고, 내각법제국을 중심으로 법률의 위헌성을 사전에 해소하려는 노력이 있었다. 그러나 최고재판소에서 이를 최종적으로 위헌판결한 예가 10건 이내이다.　따라서 이러한 헌법소극주의에 대하여 일본내에 많은 비판이 있어 왔다．　 이러한 비판에 따라 대두된 것이 헌법재판소 설치론의이며, 요미우리신문의 개정시안과 2007년 나카소네 전 수상이 회장인 세계평화연구소가 헌법재판소를 창설하는 헌법개정시안을 제공하는 등 구체적으로 헌법재판소의 설치와 그 권한에 대하여 제시하게 되었다. 현재도 일본에서 헌법재판소 설치를 헌법개정안에 대해서는 현재도 중의원, 참의원의 헌법조사위원회 그리고 학계 등을 중심으로 연구·검토되고 있다. 그리고 헌법개정 사항이 되어야 할 헌법재판소의 설치에 일본내에서는 찬반·양론이 다양하게 제기되고 있으며 추상적 위헌심사제의 도입론, 구체적인 규범통제 구성, 재판소내 헌법부의 설치론, 최고재판소에 법관출신 직업재판관의 비율을 낮추고 비법률가 헌법재판관 등의 비율을 높이는 것 등을 논의하고 있다．　 이러한 논의는 일본의 헌법개정논의와 함께 계속 될 것으로 보지만， 일본은 독립한 헌법재판소를 신설하기까지에는 많은 어려움이 있을 것 같으며, 로스쿨 도입이후 헌법소송의　교육 및 헌법의식 고양 등으로 헌법소송의 수와 논의를 늘리는 방향을 취할 것으로 본다. 이러한 그들의 고민을 이미 헌법재판소를 모범적으로 운영하고 있는 대한민국에서도 반면교사로 삼으며 계속 지켜보며 연구․검토할 필요가 있다.

영문 초록

Article 76 of a Japanese Constitution vests judical power in the Supreme Court of Japan and the Supreme Court also has the authority of judicial review. From the 1950's, there have been a lot of constitutional judgment cases of lower courts throughout the development of the constitution lawsuit theory. There was an effort to find the unconstitutionality of the law on the Cabinet Legislation Bureau, however, Supreme Court of Japan have only ruled the unconstitutionality in less than ten cases. This brought a lot of criticisms for such constitution depolarization attention in Japan. The establishment of the Constitutional Court has been argued from such criticism. The Institute for International Peace, which the late prime minister Nakasone is currently chaired, submitted a proposal on the establishment of the constitutional court. The tentative plan of the revision of the Constitution of the Yomiuri Shimbun(a newspaper publishing company) provided for the installation and limit of the constitutional court concretely. Academic circles are examining for the proposed constitutional amendment for the installation of the Constitution court in Japan and the Committee of the investigation of the constitution of the House of Representatives along with the House of Councilors stated their positions as to the installation of the constitutional court. The discussion includes unconstitutional adjudication system in abstract, raising the rate of non-lawyer's constitution judge of the Supreme Court by lowering the ratio of the judge, and the installation theory judicature of the constitution of the Supreme court. I think there will be a lot of difficulties before an independent constitutional court is to be set up. But after introducing the law school system, the academia will discuss more about the constitution lawsuits as a way to increase attention of Constitutional matters along with the discussion of the revision of the Constitution of Japan. The Republic of Korea has already established the Constitutional Court and have been managing it successfully. It will be meaningful to follow up on this issue.
