국문 초록

「대통령기록물 관리에 관한 법률」은 2007년 대통령기록물의 보호ㆍ보존 및 활용 등 대통령기록물의 효율적 관리와 대통령기록관의 설치ㆍ운영에 관하여 필요한 사항을 정함으로써 국정운영의 투명성과 책임성을 높이기 위하여 제정되었다. 이 법률은 대통령기록물의 소유권이 국가에 있음을 명시하고 대통령의 직무수행과 관련한 모든 과정 및 결과가 기록물로 생산ㆍ관리되도록 하였다. 따라서 이 법률에 의해 대통령기록물의 효율적인 관리와 대통령기록관의 설립 운영의 근거를 마련할 수 있게 되었다. 이 논문에서는 이러한 대통령기록물관리법에 관한 헌법적 의미와 법 내용을 살펴보고 시행 과정에서 문제가 되었던 몇 가지 문제점을 지적하고 법률의 해석론을 제시하고자 하였다.

영문 초록

'The Presidential Records Act' has been enacted to manage protection, preservation and application of the Presidential records efficiently and to promote reliable and aboveboard administration by setting requirements about establishing and managing the Office of the Presidential Records in 2007. It has stated clearly that the nation has the ownership of the Presidential records and also has made every process and results related to the President's duties to be produced and managed as a record. Accordingly, this act could arrange an efficient management of the Presidential records and provide a basis for the establishment and management of the Office of the Presidential Records. The purposes of this thesis are to examine the constitutional meaning and its contents of the Presidential Records Act and to offer construction of law by indicating some issues that has been brought up during the enforcement process.
